I saw the following article on my e-mail server this morning and thought I would share it here.

**Man Accidentally Divorces Wife in Sleep

Tuesday, March 28, 2006 **

NEW DELHI - Village elders ordered a Muslim man in eastern India to leave his wife after he accidentally divorced her in his sleep, a news report said Tuesday.

Aftab Ansari uttered the Urdu word for divorce, “talaq,” three times in his sleep, prompting his worried wife to discuss the matter with her friends, according to the Press Trust of India news agency.

Under Islamic law, a husband need only say “I divorce you” three times to secure a permanent end to his marriage.
Muslim leaders in the couple’s village in West Bengal state found out and decreed that Ansari’s unconscious utterances constituted a divorce, PTI reported.

But 30-year-old Ansari said he had no intention of leaving his wife of 11 years.
“I have not given talaq. When I uttered talaq three times I had taken medicines to help me sleep,” he was quoted as saying in the report.

The religious leaders said that before remarrying, the couple would have to be apart for at least 100 days and that the wife, Sohela, would also have to spend a night with another man and then be divorced by him.

PTI reported that the couple has been ostracized because of their refusal to abide by the decision of the village leaders.

Sometime they are religious leaders and another time they are the village elders.!
She would have to spend a night with another man? what a falsehood!! I am disgusted how people would go this low to bash a religion. The link above explains this

i read it and thats the stupidest thing i have ever seen… divorce isnt as simple as that…and he was sleeping…any thing that you say or do while sleeping or unconsciously is invalid

This is a pretty funny story. I wonder if it’s “The Onion” at work.

Joseph,

I thought this was pretty ignorant myself, that is why I posted it here to see what others thought. Here is a link that has the article: abcnews.go.com/International/wireStory?id=1776288

Is Aftab Ansari the name of only one man or is this another Aftab Ansari in India? Just a thought.

Muslim,

I completely agree!

From Islams point of view, no divorce has occured. Not even near it.

From a total ignorant village elder wanna be who wanna have some spot light and make funny jokes and amusement , its a different story.
This guy who gave this opinion is the most ignorant muslim about Islam i ever saw or heared of ,

Its not teh first time jokes like this comes from India though,

She isn’t allowed to marry him then.

Yes, marrying a man with the intention of leaving him just to get back to your first husband is forbidden, as Muslims we are to enter into marriage with the intention of not leaving it. My interpretation is from the Quran itself.

YUSUFALI:** A divorce is only permissible twice**: after that, the parties should either hold Together on equitable terms, or separate with kindness. It is not lawful for you, (Men), to take back any of your gifts (from your wives), except when both parties fear that they would be unable to keep the limits ordained by Allah. If ye (judges) do indeed fear that they would be unable to keep the limits ordained by Allah, there is no blame on either of them if she give something for her freedom. These are the limits ordained by Allah; so do not transgress them if any do transgress the limits ordained by Allah, such persons wrong (Themselves as well as others).

YUSUFALI: So if a husband divorces his wife (irrevocably, meaning the third time), He cannot, after that, re-marry her until after she has married another husband and He has divorced her. In that case there is no blame on either of them if they re-unite, provided they feel that they can keep the limits ordained by Allah. Such are the limits ordained by Allah, which He makes plain to those who understand.

🙂

thx Emad but am afraid you didn’t get my question.

where did you get the idea from that she cannot marry another man and divorce him IN ORDER to go back to her first husband?
this happens a lot …i personally know one man who used to “work” as muhallil…that is, his business was to marry a woman and divorce her IN ORDER that it becomes halal for her to go back to her first husband.

Oh sorry, now I get your question :o . The Prophet peace be upon him prohibited it.

Imam Ahmad reported that Abdullah bin Masud said, "Allah’s Messenger cursed the one who does Tahlil, the one in whose favor it is done, those who eat Riba (usury) and those who feed it (pay the usury).’’

Tahlil is to sleep with that mans wife in order to make her halal for him.

In his Mustadrak, Al-Hakim reported that Nafisaid: "A man came to IbnUmar and asked him about a man who divorced his wife three times. Then, his brother married her to make Tahlil for his brother, without the brother knowing this fact. He then asked, "Is she allowed for the first (husband)’’ He said, "No, unless it is a marriage that involves desire. We used to consider this an act of adultery during the time of Allah’s Messenger .’’

`Umar said, "If the participants to Tahlil are brought to me, I will have them stoned.’’

yep that’s it 🙂

i found this as well

Ibn Abbas (Radiya Allahu Anhu) said: ‘A husband was more entitled to take his wife back even if he had divorced her thrice but this ruling was abrogated by this verse: {And if he has divorced her (the third time), then she is not lawful unto him thereafter until she has married another husband. Then, if the other husband divorces her, it is no sin on both of them that they reunite, provided they feel that they can keep the limits ordained by Allâh.}.’

then the passages you quoted 🙂 thx.

She then marries another man and he divorces her before he has sexual relations with her, would she be allowed for her first husband Allah’s Messenger said:

«لَا، حَتَّى يَذُوقَ عُسَيْلَتَهَا»

(No, until he enjoys her `Usaylah (sexual relation).)

So a woman cannot remarry her first husband unless her second husband enjoyed her sexually…i think the idea is much clearer now.
