For the other question - if it was an invalid marriage - such as not done in a church - yes the finding of anullment is still needed to show there was not sacrament. One of the points of confusion here is that an anullment says there was no marriage - it does not - it simply states that there was a lack of sacrament.

Marriage is a sacrament only for those who have been baptized. Any two baptized people who have a valid marriage also have a sacramental marriage. However, two unbaptized people or one baptized person and one unbaptized person can have a valid marriage, but that marriage is not a sacrament.

That said, I’m not sure what Joan meant. A declaration of nullity speaks to the validity of the marriage.

Just thought I’d give you all an update.

I have a job that pays less than what my wife makes, for the past 2 months since she works as a freelancer she has not brought in a great amount of money and we have been relying mostly on my income. She got paid last night and immediately asked for 1/2 of all the bills. I just don’t have the money to pay that. So now she has money her position is that I should leave because I cannot split the costs 50/50. That was number 1.

Second, she quoted our pastor’s message that divorce was not a sin and since she never intends to re-marry she is not breaking the vow, and she received this advice from a priest in confession.

What a life, truly a spiritual blow, but God does make it interesting.

I, not wanting to be sexist, believe this applies to both sexes, and this is why the church recognizes all divorce as grave and makes exception for safety and infidelity. Anyway, food for thought.

“WHOEVER DIVORCES HIS WIFE FOR ANY REASON EXCEPT SEXUAL
IMMORALITY CAUSES HER TO COMMIT ADULTERY” - Mt 5:32
1. The only acceptable grounds for divorcing a wife is SEXUAL
IMMORALITY
2. Otherwise, divorcing a wife “causes her to commit adultery”
3. How? By placing her in a position where she is likely to
remarry, in which she becomes an adulteress
4. This is what the Law implied in Deut 24:4 and Jer 3:1
a. That is why the first husband couldn’t take her back
b. Even if her second husband had died!
c. Because the wife had become “defiled”!
5. Notice these comments by KEIL & DELITZSCH…

     a. That Jesus' teaching was really in harmony with the Law
        itself
     b. But the "traditional interpretation and application" of the
        Law had missed the mark by placing emphasis upon the 
        mention of giving a certificate of divorce

Hi Jim, if I could just say a few things. You must remember there are 3 sides to every story. Your side, your wifes side, and the truth! Now I am not saying you side is not the truth. But in the defense of the Priest we do not know Jim what she has told him. He is only human Jim. I mean she could be lying like a rug. Or you could be also Jim. See what I mean. We cannot accuse the Priest because we do not know.

Please understand I am not saying you are lying either, I don’t know. Here is my best advice for you. Go to another RCC far from your own. Call Father and make a Appointment. He will help you. Just say I need to talk to a Priest. There are good ones Jim.

Tell the Priest the truth. Remember Jim maybe the Priest did not say that to your wife either. Sometimes we hear what we want to hear or misunderstand. I have done it on this thread alone. Or maybe you wife is lying to you about the priest the same way she is lying to the priest about you. I don’t know.

Now the gay marriage being okay in the RCC. Now thats messed up. It is not true. So thats a big problem. Now either the Priest was misunderstood or wrong. That is an easy one.

But try another Priest first. I believe it will help you.
 
And if I can say one more thing. My Dad was as RC as you can get. After he retired he served mass sometimes 3-5 days a week. He was very close to Father. He went to mass every day.

BUt if Father said Gay marriage was okay my Dad would have been waiting for Father after mass. I could hear my Dad now. His words would be Father now wait a minute what are you telling me? HE would say Father this is not right. Now if Father persisted to teach a lie he would leave that Church I can tell you that. And so would many other people. The people would not stand for this. So I also find it hard to believe that the people in the Church just let this fly right over them.

I as a RC must give the Priest the benefit of doubt. Forgive me I must. BUt I understand there are bad priests. I hate to say this, but I know there are. But there are more good ones. And unless I heard this with my own mouth, I must give the Priest the benefit of the doubt. Sorry thats my stand!

Jim as much as my heart is hurting for you, I must stand by the Priest. Please forgive me. I am not saying I don’t believe you either, its just hard to accept that a Priest would do this. But if he did, trust me, someone will tell the Bishop. And if he is doing what you are saying he will be removed. But I will pray for all of You.

I was answering another posters question about why a lackof-form decree of nullity would be needed for her son to remarry in the Church. If you can help on this matter that would be wonderful. Thanks.

Ah yes, I recall that now! My answer for that is simply that even open-and-shut cases still need to be investigated. The Marriage Tribunal won’t “know” there was a lack of form until someones goes in and fills out some paperwork that let’s them know they did not get married in a Catholic church. So everyone still needs to go through the process even though, from the vantage point of those involved, the end result is obvious.

Such cases will go through the process much more quickly than those that did have proper form. But they still need to go through the process.
