Greetings all

A friend at work here asked me a question and I wanted to double check myself.

Two non-Christian, un-Baptized people get married in a civil ceremony by a justice of the peace. I know they are considered civilly/naturally married.

Now, say that the woman in this marriage has a conversion experience and recieves a valid Baptism in a non-Catholic Christian church. She was Baptized invoking the Trinity, in water, by a minister/church that believes in the Trinity (I believe this was a Southern Baptist Church but I could be wrong, it was some type of more mainstream Christian denomination though that used submersion).

Anyways, after this Baptism, the couple got a divorce.

My question is, from the Catholic perspective, if the woman now marries another validly Baptized adult that has no previous marriages. Would this be a sacramental marriage recognized by the Catholic Church? I believe yes, but I wanted to double check with you guys as I am still trying to get a sturdy grip on the theology behind all of the Sacraments.

First of all, why did they divorce take place? Were they not living in harmony after the conversion? She would need to present a petition for an annulment for the marriage between the un-baptized person and the newly baptized person. When two unbaptized people are married, that marriage is non-sacramental and can be dissolved in favor of a new marriage after one party receives baptism. This presumes that the party seeking baptism is not the cause of the breakdown of the marriage. After the Tribunal finds that the first marriage is null and void then the baptized can get married. She would not be able to marry until she is granted an annulment from the Tribunal.

If they had sex after one was baptised and no impediment existed, they are validly married unless a defect of consent (fear, simulation, gross lack of maturity, gross lack of judgement etc) persisted.
