MP3 downloading

Just recently I downloaded a song from youtube Via a youtube to MP3 website, now Before you make a snap judgement what I downloaded was a video game theme from the 80s or 90s anyway it’s a theme from an 8-bit video game and i downloaded it to remix it in the first place I was wondering if this is considered stealing in this case specifically, even though its only for use and Im pretty sure its not sold as actual music

If someone owns the right to that song, then it would be stealing. If it is in the public domain, no worries. If in doubt, find out if some owns the rights to the song. If so, you can always try to contact them.

It’s a gray area in my opinion. The music is on youtube so supposedly that site has the right to play that video/music. You, as the consumer, use youtube in good faith believing that they have permission to distribute the videos you are consuming. All you did was convert one digital format (flash video) into another (mp3) for personal use.

If it is just for personal use then you should be fine. However, if you plan on remixing it and then distributing it then you will need the permission of the copyright holder unless it is distributed under a license that allows for remixing (which I doubt).

One last thing, be careful about using the reason of “it’s not sold any more.” Just because someone chooses not to sell something does not mean the world is free to have it.
