Nebraska man charged for sex with wife, 13
Families support couple, but prosecutor calls union ‘repugnant’

LINCOLN, Neb. - A 22-year-old man faces criminal charges in Nebraska for having sex with an underage 13-year-old girl, although he legally married her in Kansas after she became pregnant.

The man’s lawyer said the couple, with their families’ support, “made a responsible decision to try to cope with the problem.”

Matthew Koso, 22, was charged Monday with first-degree sexual assault, punishable by up to 50 years in prison. He was released on $7,500 bail pending an Aug. 17 preliminary hearing.

After the girl became pregnant, her mother gave permission in May for Koso to take the young woman to Kansas, which allows minors to get married with parental consent. The girl is now 14 and seven months pregnant.

“The idea … is repugnant to me,” said Nebraska Attorney General Jon Bruning. “These people made the decision to send their … 14-year-old daughter to Kansas to marry a pedophile.”

Kansas law labeled ‘ridiculous’
He said the marriage is valid, thanks to the “ridiculous” Kansas law, “but it doesn’t matter. I’m not going to stand by while a grown man … has a relationship with a 13-year-old — now 14-year-old — girl.”

Bruning, who has said he will seek a second term in 2006, has aggressively prosecuted sex crimes against children since he was elected in 2002

The couple were married in May by a judge in Hiawatha, Kan., just across the state line from Falls City.

Nebraska allows people as young as 17 to marry if they have parental consent.

Kansas law, however, sets no minimum marriage age, although case law sets the minimum age at 14 for boys and 12 for girls. The marriage must be approved by both parents or guardian, or by a district court judge, said Whitney Watson, spokesman for Kansas Attorney General Phill Kline. A judge also must approve if only one parent approves.

Koso’s lawyer, Willis Yoesel, said the girl’s mother and Koso’s parents approved of the marriage. He said the girl’s father has not lived with the family for some time.

‘The families are all united’
“It seems to me like they, as much as they could, made a responsible decision to try to cope with the problem,” Yoesel said.

“The families are all united in this effort,” Yoesel said. “I don’t know who is complaining. … What benefit is there to anybody in the prosecution of this young man?”

There was no comment from Koso, who does not have a listed telephone number.

My grandmother was married at thirteen, pregnant by fourteen, and this was the norm. I don’t know how I feel about this to tell you the truth…I would freak if it were my own daughter…but these people might believe differently from myself…does that make them wrong? I dunno

And it appears that the man had sex with her before the marriage. In fact, the marriage only happened at all because he made her pregnant. On the evidence at hand, I agree with the prosecutor.
 
I believe the crime was fornication, prior to the marriage. It is against the law in Idaho for example, to fornicate. Whether or not the criminal marries after the crime is irrelevant. If he or she was guilty of fornication, civil authorities have every right to punish them.
 
He got her pregnant before they got married, so he is a pedophile, and should be charged. I don’t care how young people got married way back when. Nowadays, adolescence is stretching out our childhoods. That girl’s parents failed her by sending her off to marry her molester. I think the prosecutor is doing the right thing.
 
Who cares what the girl thinks? She’s only 14. She can’t make a mature decision about this. A 21 year old having sex with a 13 year old is abhorrent. It doesn’t matter if they’re married or not.
 
The parent’s should be thrown in jail along with tje 22 year old who diddles 13 year old girls. Sick, sick,sick. :mad:
 
Oooh, I hate the word 'diddle". I think the guy should be punished as well. Thirteen is a child. Otoh, if he is in jail, who will pay to support the child?
 
Do they have a family cell for him, his parents, and her mother?

Since the girl was post pubescent (she was able to get pregnant) this was not pedophelia. In our culture, the guy is just a pervert, not a pedophile.
After the clerical sex scandal, the media has many convinced that having sex with minors is pedophilea, but it isn’t in the case of many of the clerics, it was homosexuality, however calling it the ‘homosexual clergy sex scandal’ was apparently too taboo of a title.
 
If the criminal charge specifically referred to the act of intercourse that resulted in the girl’s pregnancy, after which the man married the girl, I do not think we should consider this to be “a man charged for having sex with his wife”. He was her molester, her rapist, at that point, and she was his victim…they were not in a consenual relationship, let alone a covenantal loving one worthy of sacred respect!
This is a different case altogether, a case in which the state is properly exercising its duty to enforce the law. Headline writers and thread starters, please be clear!

Actually, the crime is more likely statutory rape. I don’t know what the law is in Nebraska, but here in Michigan it is illegal and automatically considered rape to have sex with a minor under the age of 16. If they had waited until they were married with parental consent to have sex, I imagine the marriage would trump the statutory rape laws and no crime would have been committed (bizarre as that is). But because he impregnated a 13-year-old girl to whom he was NOT married, he is likely considered a rapist and possibly a pedophile.

I cannot imagine what was going through her mother’s mind. If my 13-year-old came home pregnant by a man 9 years her senior, I would have that man arrested so quickly that he wouldn’t know what hit him. Grown men who go for children are generally put on sex offender registries, and for good reason.

If it were my 13-year-old daughter and a 22-year-old man, the person more likely to be arrested quickly would be me. The 22-year-old man’s arrest would have to wait after he recovered from the beating.

Don’t get me wrong, I think it is sick, but more than likely she knew what she was getting herself into. At 11, kids know what sex is, how to do it etc. by 13, a lot are already having it consensually. At least those that I know of anyway. She may not have been brought up in a proper household, but I believe it was pretty consensual. A lot of you are saying that 13 is just a baby and most likely you have kids and that is the reasoning behind it, but 13 year olds today are as “mature” (for lack of a better word) as the 18 year olds of a decade ago. The sex they have been subjected to through everyform of media prepared them for it…

We need more men to be strong leaders and do the right thing when it comes to protecting and leading their families. When a child can count on her parents discipline and defense–things like this don’t happen in the first place.

Me too…I always said if anyone messed with my daughter or sons they better pray that the cops catch them first. I would plead temporary insanity on a murder charge…I don’t think there is a judge in this country that would convict a single mom for protecting her kids…but then again the judges we have now…

It depends on the girl. It is possible that she is capable of consent, but since it is very easy to twist a 13 year old girl into doing most anything if you apply the right pressure and remove the right supports, I doubt it. The consent is probably illusory. She surely is not cabable of a consent equal with the guy. He is substantially more free than she in the situation. She is still under the care (and control) of her parents. Many girls are just plain obedient and cooperative at that age, even though they may be starting to at least talk otherwise. This works against them if their parents don’t protect them and they have an unethical person in their environment.
