with her brother/my grandson who is 9 about going to Church when I take them to counseling. My grandson stays with dad since dad moved out, with mom’s blessing- there is no protection order on him as the allegations are only on my granddaughter and social service said they couldn’t do anything about him staying there.
Please have a lawyer look at the protection order. Usually in child assault/molestation these are worded to so as to prevent all contact with all children of a given age bracket (at least the dozen or so I’ve seen). I am also very surprised to hear that the children were not removed from the home and placed in foster care or halfway services which is what I have usually seen happen in such cases. Something just doesn’t make sense here by leaving the boy with the father. This is where you really need to seek legal counsel… don’t try to do this yourself - the abuser will have counsel I assure you and they are experts at twisting the facts.
  • If the warrant is not specific to your G.D. then take your notes first to social services and child protection. Show them the warrant and ask for a senior agent. The primary case workers are often simply overworked and don’t really take the time to investigate.
Failing that, contact your county attorney’s office and take the warrant and your notes to the CA and ask them to enforce the warrant. If they refuse, contact the issuing Judge and plead you case before the magistrate for a bench warrant for the arrest of the Father in contempt if the order - once again I highly advise you to seek and retain legal counsel before you start this process…
