good questions.

If illegal, then it would be off the table. However, taking that aside, at what point would taking welfare when it is not needed be immoral vs overly scrupulous?
REALLY OVERLY SCRUPULOUS!!!

I am sure that’s what your priest will say when you detail your deceit to him.

And I have a job and own a company that provides employment for others … so I am not choosing a path that is cheating the government at all - you know nothing about me …
The point is you make choices and sometimes the choice will result in money going to the government and sometimes the choice will result in less money going to the government. I am likewise trying to make a choice between various options to determine which choice is in my families best interest.

Likewise, we have never taken a penny of welfare. But, I see welfare going to a lot of people who have less claim on it than I do.

Your ideas about welfare are pure fantasy.

When they government finds out your wife is on welfare and you are paying no child support or alimony, then they will suit you for payback of the welfare she received since you have primary duty to provide child support.

What if the child is receiving K-TAP (welfare)?
If a child is receiving K-TAP benefits, the Commonwealth of Kentucky will bring a child support action against the non-custodial parent(s) to obtain re-payment for the state’s support of the child. The local Child Support Enforcement office will contact the child’s custodian to get the name and address of the non-custodial parent(s). Refusal to provide this information about parent(s), or providing false information, is a crime. KRS 205.785.

Royal Archer -

You said you were going to end your ‘civil’ marriage by divorce or separation but not end your sacramental union … specifically to get benefits …
You seem to be misreading things. I did not say I was going to do anything, I have been asking about the legal feasibility around various options with the intent to follow the law.
You said you do not really intend to live in separate residences - as individuals living totally separate lives - but merely make that appearance for the sake of gaining benefits …
No, I said I was thinking about various scenarios one of which would be cohabitating without a civil union, if the law allowed it.
You seem to have missed numerous clarifications and qualifiers that I have clearly stated.
This entire scenario you have laid out is focused upon gaining some benefit … by the appearance of being apart living independent lives when you won’t actually be independent …
It is an intent to gain some benefit with the questioning about what potential arrangements would be legal.
Sorry - you can be hurt by the truth - but the truth is you are only trying to understand the law in order to find a way to circumvent the law - by illusion … that is fraud and that is wrong … there can be no sugar coating …
The truth is fine, taking something out of context and wrapping into a new context upon which accusations are being made is not the truth.

When you are filing your taxes do you read the tax laws to determine what is deductible? if so are you trying to circumvent the law? What I have been trying to do is the same in that there appeared to be a legal option and I was exploring that option.

Government does many things for the good of society that people who can afford to do with out, take advantage of.

So do you believe there is never a case where the government may do something for those who need it where it is OK to take it even though you are not in dire need?

What about well off seniors turning down social security payments? wouldn’t you look at someone who complains about seniors who can afford to live with out social security accepting it as over scrupulous???

If parents can afford to send their kids to private school but still send them to government schools are they exploiting something intended to help the needy? or is the questioning of a parent sending their child to public school over scrupulous???

Thank you that is helpful.

I had seen in other states that this was run differently.

Social Security is a pension system. An earned system.

Schools are not designed only for the needy. In fact the rich pay far more for public school in taxes than a low income person.

What you are doing is unjustifiable.

And yes it is immoral to take something you do not need just because you can…

But, as for you, when you hoard all these things in the insatiable bosom of greed, do you suppose you do no wrong in cheating so many people? Who is a man of greed? Someone who does not rest content with what is sufficient. Who is a cheater? Someone who takes away what belongs to others. And are you not a man of greed? are you not a cheater? taking those things which you received for the sake of stewardship, and making them your very own? Now, someone who takes a man who is clothed and renders him naked would be termed a robber; but when someone fails to clothe the naked, while he is able to do this, is such a man deserving of any other appellation? The bread which you hold back belongs to the hungry; the coat, which you guard in your locked storage-chests, belongs to the naked; the footwear mouldering in your closet belongs to those without shoes. The silver that you keep hidden in a safe place belongs to the one in need. Thus, however many are those whom you could have provided for, so many are those whom you wrong.

Really I don’t know what to say. Yes, I despise the government trying to redestribute wealth. I am not happy that I paid more in taxes last year then one of my unmarried sisters has in 10 years. But I care even less for someone who trys to game the system.

Every person who commits fraud or plays the system doesn’t hurt others committing fraud. They impact people like me who already pay 10s of thousands in taxes. That pocket you are reaching into isn’t the couple shacked up across the street, but rather mine and the rest of us that pay taxes. Your plan just shift more cost to me and others like me. How would you feel if I shifted the financial burden of my wife and 6 kids to you instead? Hey I got the money, but if I can you to pay for it great. More for me.

You say you respect the sanctity of marriage, but at the same time you want to play legal games that undermine the very foundation of marriage. What you propose further errodes marriage and you spit on everyone of us that fight day after day to uphold traditional marriage.

It doesn’t matter if you can find a legal way to do it, its morally reprehensible. I would not want to explain how I worked the system to my advantage on judgement day.
First of all it is starting to look like there are no pragmatic ways of doing this with out lowering my families standard of living.

unfortunately many people treat the government like an all you can eat buffet. yes when some go overboard it raises the prices for everyone who is paying. but given that I am having to pay more than ever, is it wrong to look into legal ways of recouping my losses or getting the benefits I am paying for?

I have been very prideful and not taken advantage of hand outs that were available but at what point is that pridefulness hurting my family.

the potential fallacy of the your presumed argument is does accepting welfare take from the needy or does it take from the rich or does it take from many others who are also just willing to accept the hand out because it is available.

I believe that I can do more good with the money that the government can by paying people to remain unemployed and single.

There is no fallacy.

You steal from society.

If everyone did what you propose the system would fail and the people who need it would not have it.

I agree that it is a failed system. I do not like it. however, I am being forced to fund it. As such, if people who are not needy are receiving money from it, then shouldn’t those paying into it have more of a right to extract benefit than those who do not pay in?

Sure, but the way we set that up legally is to legislate a different system.

but until that happens, we operate within the system of laws as they are written today.
And you somehow think that it is legal still.

But even if it’s legal does not mean it is right and just.

Abortion is legal. Is that moral. Is that just?

Slavery was legal, beating your wife was legal. Etc…

I have been studying this law for the past 6 months in order to work on client communications. While the Affordable Care Act (sorry, it’s not the President’s plan and doesn’t bear his name despite popular lingo), the combined household income is added together, then if it is below a certain level, you receive “credits” (sort of an instant rebate) to decrease the cost of your insurance premiums. If your employer discontinues his plan or if his plan is less than the ACA standards, you can enroll in a state plan at least for the coming year. Add your income and your spouse’s income together, then call the state marketplace number and give them the income and the number of dependents. The ceiling for income and premium assistance is way above what some middle class families make. If your spouse doesn’t work, it’s only your income taken into account. Some employer plans offer a flexible spending account where you can pay up to $2500 of your medical expenses in pre-tax dollars (you’re not charged taxes on this amount). You do have to use the funds you set aside for this purpose each year or lose the remainder, but in a family with children, that’s not a problem usually. Other plans offer a Health Savings Account that gives the same pre-tax benefit but you can roll over any leftover money into the next year’s medical HSA. There is generally a less drastic option than contemplating separation even as a legal fiction if you know how the system works. If you need more help, email me privately.

Actually, I get this guy’s point–it took me reading a few responses and his replies before it sunk in with me–but I get it! I suspect he’s not so much serious in wanting to commit fraud as he is simply verbalizing a feeling that many of us share today–me included. It almost seems as if society punishes those of us who live traditional lives–who go to work, earn our own food, buy our own clothing and pay for our own housing. Obamacare, even as hard as it is to currently check potential premium estimates with the whole system down, is almost the final straw. His point is that it is wrong —a GREAT SOCIETAL SIN in my opinion–to see single women collect more and more money and food stamps each month for simply living their lives with their legs spread to any man who wanders in and out of their life and impregnates them once a year. He works and pays for his cell phone. People on welfare often set at home and get a free cell phone. He works and pays for his home. He sees people who don’t work–and they live in subsidized housing and YES–often the woman is the one qualified and receiving the benefits, but her boyfriend of the month is living with her and the caseworkers know it–but unless the woman is stupid enough to write it down, the authorities turn a blind eye! Extra food stamps are traded for x-boxes. WIC provides them enough extra milk, cheese etc that I’ve seen people selling it or trading it on the local on line salecycle in my town for video games, high heels and all kinds of things–and again, I’m perfectly aware that a blind eye is turned. Why do more “poor” women bottle feed than breast feed as a rule? Why not? The government gives them free formula! Current society is so concerned that these people’s kids might not get a good education since they are supposedly living in poverty–even though sadly, most of them will also be pregnant by 16 and on welfare since for so many, it’s a family tradition–that these kids gt free “Head Start” even if the mom is setting at home on her butt. But, as a working parent, if we want our pre-schooler to be in a headstart type of program, we have to pay through the nose.

I get the thread starters point–and hey buddy, I HEAR YOU! Remember when you vote next time how you feel right now. I think in a perfect society that every person should have health insurance too. I just don’t think I should have to pay for it! If Obama or Reid or Pelosi want it given away for free–let them pony up! They didn’t even return the salary they collected during the government shut down! I get tired of being their mule too! And there is a huge difference between Christ’s admonition to feed the hungry and clothe the naked than some politician’s socialist belief that we should enable the lazy or enslave the industrious to promote the unwilling I agree, but it’s not worth it to me to chance going to jail to make a statement to a government that doesn’t listen anyway–because we continue to elect leaders who don’t listen and who are so rich that none of it even touches them! Even to make a statement–which you did well and which I get! LOL!👍

Ok,

4.1% of Americans receive welfare.

Welfare costs the US $131 billion annually.

Total federal budget is $3.8 trillion

So that means 3.4% of federal budget is welfare.

So 3.4% of your taxes go to welfare.

If you make $100,000 a year you pay about 12,0000 in taxes

So 3.4% of that is $430.

You want to do all this fraud, mortal sin family division over the fact you pay $430 a year to help those who are in a bad spot? Even if some abuse that system?
Using your numbers.

Roughly 330,000,000 milion people in the US.

.041 X 330,000,000 = 1,353,000 people receiving $131,000,000,000 or each person on welfare is getting $96,821.88. The average family of 4 on welfare is collecting a $387,287.52.

I don’t think your numbers are correct.
