Fort Hood, TX – A pro-life legal group has asked the U.S. military to charge Maj. Nidal Malik Hasan with the unlawful killing of an unborn child in the shooting that recently took place at the Fort Hood military base. The initial 13 murder charges do not include one for the death of an unborn child, the fourteenth victim.

In the crash of flight 1407 in Buffalo they do not count an unborn baby there either. It is a shame.

As I posted before:

Personally, I see no reason why Mr. Hasan shouldn’t be charged with 14 counts. It is the law i.e. Unborn Victims of Violence Act in 2004, Federal…AND State of Texas Criminal Code 2003.

BUT there are people like Mr. Obama who would prolly see it as confirmation of life of the unborn…and a risk to his standing with his backers.😦
 
As I posted in another thread, the US military has no article to charge him with under the Uniform Code of Military Justice. President Bush issued an Exec. Order in April 2007 that made killing of the unborn a crime punishable under either the murder (Art. 118) or manslaughter (Art. 119) of the UCMJ. It added verbage to the articles to include the unborn under those articles.

When President Obama took office, he nullified most of the Bush administration’s Executive Orders, that being one of them. That leaves the military without the ability to charge for the crime of killing an unborn baby.

The suspect would have to be charged and prosecuted under federal or state laws for that specific count.
 
Hasan will either be spending the rest of his life in jail or will face the death penalty. That will happen whether he is charged with 14 murders or only 13.
