Proposed Amendment Would Ban All DVD Copying

A proposed amendment to the current copy protection license governing DVDs would completely ban all DVD backups, and prevent DVD playback without the DVD disk being present inside the drive.

The proposed amendment was made public in a letter sent by Michael Malcolm, the chief executive of Kaleidescape, a DVD jukebox company which successfully defeated a suit by the DVD Copy Control Association (DVD CCA) this past March. The proposed amendment is scheduled for a vote on Wednesday, according to Malcolm.

A spokesman for the CCA said he was not aware of the proposed amendment, but added that he could not comment until the CCA had finished its deliberations. A spokeswoman for Kaleidescape said she understood that a final decision could take weeks, if not months.

A very stupid and scary law if passed. This would totally violate our own property rights. If this passes, then it would mean gun makers could tell you not to use guns we buy in self defense, it would mean food sellers could tell you not to eat their food that you paid for, it would mean water providers could tell you not to drink the water you bought. Fact is that when a seller provides you product and you buy it, it is now your property and you can do what you please with it. Amazing how our own right to property is diminishing in this country, and yet a “communist” country like China has last year enacted a law where all citizens have a right to private property and it cannot be taken away without a trial and due process.

It is not a law. And it is questionable if would even be legal.

Read the article. It is an amendment to the DVD CCA license meaning it is not a law.

The amendment (not law) would not reach individuals that are not parties to the license.

The amandment may be a bad idea (I think it is), but it cannot do any of the things you were worried about in your OP. It does not have anything to do with property rights being taken away.

Personally I think if it keeps people from making bootleg copies and giving them out to their friends its a great amendment. I think that’s why its being looked into because someone who had been given a bootleg copy could just say “oh its a backup”.

I am actually surprised people back up their DVD collection, unless they were using it to make copies of for others.

Personally I think if it keeps people from making bootleg copies and giving them out to their friends its a great amendment. I think that’s why its being looked into because someone who had been given a bootleg copy could just say “oh its a backup”.

I am actually surprised people back up their DVD collection, unless they were using it to make copies of for others.

What these people are trying to do is protect themselves from advances in technology using laws designed to protect ink-on-paper works. Ultimately, it’s an effort doomed to fail. They’re living in the dark ages, and are set to be left behind.

So all I think is this. They should adapt, or die.

I, for one, will not regret the passing of movies, DVD’s or even the kind of trash they put out today as “music”.

Great points, they simply cannot accept the fact we live in a capitalist society where they must either compete or be left behind, this is one of the reasons why industries in socialist countries like Europe are trying to sue free market mainland China because they can make superior items at much lower prices.

I work as a Video Editor so that means when people pirate videos that I have spent hours working on, I don’t get paid the extra money that was lost.

Yes I have heard of DVD’s getting scratched etc by younger children which is why we keep ours up and away until they are old enough to be taught how to respect and handle media correctly.

Just because people make backups doesn’t mean they are using them to give away, I also do video editing and I backup not only stuff I buy but stuff I make as well.

“dark ages”? “adapt, or die”? What are you talking about? People make songs and movies and expect to get paid for them, not have copies run off by someone for their buddies or to sell. I was witness to a bust of bootlegs at a convention. All you’re asking for is the right to make copies for your buddies and sell a few on the side. Do you think that rich people don’t deserve to get paid for their work?

This law is trying to prevent bootlegs form getting out there. If we don’t do this they have every right to recover costs by raising the prices on the original product. If the makers are protected form bootlegs being made then they can make the original product more affordable that if the kids scratch it you can easily replace it.

I agree and I actually think they should include a sort of warranty program on DVDs, that way there’d be no need for backups.

The scratched dvd and the Purchase docket gets sent into the manufacturer, and a new copy gets sent out…

Actually, when I worked at Circuit City they did offer a replacement guarantee for a year. I think it cost like 10% of the disc purchase. Then you could return it even if the kids scratched it. Not many bought it though.

If they included this in the purchase price, people would have no reason to complain about this. The only reason they’re doing it is because of the piracy… it’s a good reason. But they have to allow replacements to be sent out because otherwise lawful people who really do only do backup for themselves will have right to complain they’re being jipped.
