There is one abortion clinic in North Dakota and the state is passing legislation that will make it more difficult to get an abortion…

North Dakota Senate Passes Two Unprecedented Abortion Bans
The North Dakota State Senate passed two anti-abortion bills on Friday that would be the first laws of their kind in the United States and would ban most abortions in the state. One bill would prevent women from having abortions as soon as the fetal heartbeat can be detected, as early as six weeks into the pregnancy, and the other bans abortions in cases of fetal abnormalities such as Down Syndrome.
The Federal Government has declared Marijuana to be illegal.

The Federal Government has declared that women have the right to abortion.

The Federal Government has declared that marriage is between one man and one woman, DOMA…

and the fight is on…States rights are in the making of legislation to limit abortion in the state regardless of what Federal Law says…the same may be true of Gay marriage as yet to be seen…
 
Women will just come to other states like ours to get abortions.

what? So, it is safe to assume that women can give away all children with down syndrome to every single men who supported this notion for them to be taken care of.?
On a serious note this will be overturned in no time.

And i do hope those obscurantists and religious extremists who introduced that bill will be criminally persecuted. Enough is enough. otherwise there will be a full scale war against a a particular denomination that thinks it can sink its dirty hands into women’s vaginas.You’ll just see.

Coptic christian you are a little confused on this let me explain. You are thinking under Roe v. Wade and Roe v. Wade was partially overturned by Casey v. planned parenthood (I am pretty sure 1995). Roe originally made abortion a fundamental right, through all nine months and nothing could get in the middle basically. This was taken back to the court in Casey and what the court did pretty much was upheld abortion (now there is a big discussion between lawyers as to if it is still a “fundamental” right, that is debatable) as a woman’s.right but what was changed was that Casey allows states to create laws to regulate abortion based on the viability of the fetus. That is why you have states coming up with laws regulating abortion. The court came up with a trimester formula and based on that formula states can pass regulation. However, during the first trimester in order for the legislation to be constitutional the legislation must pass an undue burden test. If it places an under burden on the woman, then it will be upheld constitutional.
So with regard to the ND legislation, if they are for the second or third trimester then the state has an argument, but if they are trying to pass it during the first trimester most likely it is going to end in courts and they are going to say it places an undue burden on women an strike it down. But again states are allowed to pass legislation to regulate abortion what they can’t do is place an undue burden during the first trimester
