I was married in the church, but have been separated for almost 3 years now and am dating a wonderful man. We plan on marrying after my divorce is final and, God willling, the annulment (sp?) goes through. I have been told that my situation is acceptable as long as we are in a chaste relationship. I have also been told that I shouldn’t even be dating until the annulment goes through. What do you think?
 
Dating someone, and becoming so involved that you are actually already planning to marry them, before you know your canonical status is very imprudent in my opinion.

You have created an emotional bond with a person, and promised marriage to them, when you are not free to do so. You and he will certainly be devastated in the event that your marriage is found to be valid.

You are banking on the tribunal finding that your marriage was invalid. This is not a guarantee.

I think you are opening yourself up to a lot of heartache. I would guard my emotional state carefully until I was certain of my canonical status. Only then would I make myself available for dating and building a shared life with someone.
 
Look at it this way:

Sacramental marriage is forever. So until (if) your marriage is declared null i.e. you really never had a sacramental marriage, the presumption is that you are still married.

So, until it is declared that you never really had a sacramental marriage, and as has been said, there’s no guarantees, you’re still married, and dating another man while you’re married is a violation of your marriage vows. Whoever told you this is acceptable doesn’t quite seem to understand the theology of Catholic sacramental marriage.

While it would be difficult to put such a relationship on hold until your present marriage is annuled, if you want to follow Church teachings that would be the thing to do. The other man, if he is truly wonderful, should be willing to wait while knowing the possibility that your mariage may not be annuled.

what I think is irrelevant, what is relevant for a Catholic is what the Church teaches. A person in this situation is married, and therefore may not date or enter into any kind of romantic relationship unless and until the marrige is investigated by the canon law tribunal and a decree of nullity is issued. Part of that process will involve ascertaining if there is any hope of reconciliation, which until a civil divorce is obtained, is still hypothetically possible. The place to go for advice on this which will pertain to your own personal situation, not a general comment as given here, is to your own pastor. Prayers and best wishes for an outcome for you that keeps you in God’s good graces. As someone who deals with similar scenarios regularly as part of RCIA I strongly urge you not to enter into any new relationship on anything more than a casual friendship level until the matter of your marriage is resolved. To do so will lead only to heartache and the worst possible situation for a Catholic, separation from the Church and her sacraments.
 
I definitely think there should be no dating until the annulment is in hand.Marriage is permanent until proven otherwise. There is something dishonest about it even if the invalidity is a no brainer like defect of form since marriage is a public event and there are witnesses. Of course there is always the chance that there will be no decree issued and then we have people who have shared intimacies that they never should have.
Even from a secular point of view there shouldn’t be dating until about 6 months after the divorce papers are signed and in hand even if the the actual divorce was delayed so the psychologists tell us.

The difference in what you have been told is likely based on the definition of adultery. If you define adultery as only involving sexual relations with a non-spouse while married, then a chaste relationship would not be adultery and dating would be acceptable. If you expand the definition to also include adultery of the heart (see Matt. 5:27-28), then becoming emotionally involved with another person while still married would be adultery, and thus dating would not be acceptable.

My understanding (thanks to this forum) is that all marriages are valid (not “assumed to be valid”, but actually valid) until they are proven otherwise. So even if you have the biggest “no brainer” in the world, you’re still validly married until the process is complete. It wouldn’t be acceptable to assume that an annulment will be granted and go out and date, you’d need to have the decree of nullity in hand before going out and acting like a single person.
 
One of the mortal sins mentioned on this examination of conscience is “lust of the heart” and it is described as “If I could, I would”. (Moderators, I hope it’s alright that I included a link not from CAF. If not, please feel free to edit my post.🙂 )
This rather sounds like the relationship that you are in. And since you are married in the eyes of the Church, this constitutes a state of mortal sin. Even a chaste relationship is still a relationship outside of your marriage. And as far as I can deduce from the Church’s teachings, dating while married is a sin, chaste or no.
You have my prayers, this must be a very tough situation to be in!
