"The Quran in Sura 23:5-6 says:

5 [Most certainly true believers] . . . guard their private parts scrupulously, 6 except with regard to their wives and those who are legally in their possession, for in that case they shall not be blameworthy. (Sayyid Abul A’La Maududi, The Meaning of the Quran, vol. 3, p. 237)

The key words are “those who are legally in their possession.” Maududi (d. 1979) is a highly respected commentator on the Quran, and he interprets the plain meaning of the clause, saying that sex with slave-girls is lawful.

Maududi writes:

Two categories of women have been excluded from the general command of guarding the private parts: (a) wives, (b) women who are legally in one’s possession, i.e. slave-girls. Thus the verse clearly lays down the law that one is allowed to have sexual relation with one’s slave-girl as with one’s wife, the basis being possession and not marriage. If marriage had been the condition, the slave-girl also would have been included among the wives, and there was no need to mention them separately. (Ibid. p. 241, note 7)"

        Muslims did not need to have the female slave's permission to have intercourse with her.   She was his property, (as was noted by Tabari), and thus, as property, the Muslim owner had an Allah-given right to have intercourse with her if he desired.  I have yet to find one Quranic verse or Hadith that says that the female's slave's permission was required.  All Hadith and Quranic verses that pertain to Muslim men having intercourse with female slaves always put the option on the slave-owning man, whether he wants it or not.  The slaves were not given a choice.

        Think about it from the women's point of view.  A battle is fought and her side lost.  Many of the husbands, fathers, and sons are now dead.  Some have been captured.  The women and children are also taken as captives.  Imagine the horror of the females.  Family members dead, homes and possessions are now gone, they are in the total power of their captors.

        The captives are distributed amongst the Muslim men as slaves, husband and wife captives are separated.  As soon as a female has her menstrual cycle her owner appears.  He has been separated from his wife for a while out on the field of battle, sexually hungry, and he proceeds to have sex with his female slave.

        Do you think that this female slave willingly has intercourse with him?  Is that her wish?  She has just experienced one of the most horrible events in her life, - the destruction of her tribe and family, the taking of her possessions, and being made someone's slave, and now she willing consents to have sex with the very men who brought this disaster upon her!? Of course not!  What women would look upon with loving eyes the men that brought destruction upon her family and tribe!"

He said: Yes, and added: We went out with Allah’s Messenger (may peace be upon him) on the expedition to the Bi’l-Mustaliq and took captive some excellent Arab women; and we desired them, for we were suffering from the absence of our wives, (but at the same time) we also desired ransom for them. So we decided to have sexual intercourse with them but by observing 'azl (Withdrawing the male sexual organ before emission of semen to avoid conception). But we said: We are doing an act whereas Allah’s Messenger is amongst us; why not ask him? So we asked Allah’s Messenger (may peace be upon him), and he said: It does not matter if you do not do it, for every soul that is to be born up to the Day of Resurrection will be born. Abu Sa’id al-Khudri (Allah be pleased with him) reported: We took women captives, and we wanted to do 'azl with them. We then asked Allah’s Messenger (may peace be upon him) about it, and he said to us: Verily you do it, verily you do it, verily you do it, but the soul which has to be born until the Day of judgment must be born. Sahih Muslim Book 8 Number 3373

Abu Sa’id al-Khudri said: The Apostle of Allah (may peace be upon him) sent a military expedition to Awtas on the occasion of the battle of Hunain. They met their enemy and fought with them. They defeated them and took them captives. Some of the Companions of the Apostle of Allah (may peace be upon him) were reluctant to have intercourse with the female captives in the presence of their husbands who were unbelievers. So Allah, the Exalted, send down the Qur’anic verse: “And all married women (are forbidden) unto you save those (captives) whom your right hand possess.”[Surah 4:24] …Sunan Abu Dawud, Book V, Chapter 711, Number 2150
 
Raceland, I can’t believe that you said that “rape” was in our heads. I think you might have a hard time convincing the southern Sudanese people that it’s not rape:

“When we tried to escape they shot more children. They raped women; I saw many cases of Janjawid raping women and girls. They are happy when they rape. They sing when they rape and they tell that we are JUST SLAVES and that they can do with us how they wish.”

The report, … reveals how women and girls are being raped, abducted and forced into sexual slavery by the Janjawid. In almost all attacks…the GOVERNMENT’S army were either directly involved or direct witnesses.

In case you’re not up on world events, the government is an Islamic military regime and the Janjawid are an Islamic militia. The things they have done to the southern tribes (burning villages, driving them out, raping, kidnapping, murder) are EXACTLY what Mohammed did and condones and commands in the Koran. Your prophet in 23:6 flat out says there is no blame if you have sex with your captives/slaves. Show me in that passage where it says the captives/slaves have to consent. Where in the Koran does it say that verse does not apply today? Obviously the Muslim government and militia in Sudan think it still applies. They are doing EXACTLY what your prophet said to do to spread Islamic rule. If you believe it was somehow different when it was done by Mohammed, perhaps you need a serious reality check.

Since Mohammed did and commands these very actions and you must embrace ALL his teachings, are we to assume you condone and support what has happened in Sudan? If not, why not? Aren’t you disobeying the prophet if you do not support what’s been done there? They’re just spreading Islamic rule just like Mohammed did.
