Since this often comes up, I thought I’d post something that I ran across today. I’m not sure why I didn’t remember this earlier. This is from the protocol Lefebvre signed and reneged on before the illicit ordinations. If you’ll notice, the “marriages” were problematic even before the excommunications. Certainly they are still so because they have no jurisdiction.
  • Sanatio in radice, at least ad cautelam, of the marriages already celebrated by the priests of the Society without the required delegation.

I think the only possible debate here would be whether or not Can 144 takes effect some of the time.

Can. 144 §1. In factual or legal common error and in positive and probable doubt of law or of fact, the Church supplies executive power of governance for both the external and internal forum.
I don’t think anyone who reads this will be in “positive and probable doubt,” as I believe it is negated as soon as one learns that the Priest does not have the proper jurisdiction. If you were ignorant of any of the problems with jurisdiction, I think the Church would supply the governance.
This seems to be the only part open to debate.

I’m glad to see that it’s not being debated but I’m shocked! This one’s been debated unto death. Maybe this was the Holy Grail of responses.😉
 
Don’t kid yourselves. Some of us who are quite proud about being married in and still attending SSPX chapels just don’t feel the need to defend ourselves against this bull.

It is interesting that any time you novus ordos want to defend yourselves you only use Canon Law and statements from people that wrote them them to agree with your modernist thinking. I haven’t seen many quotes from the Catechism of the Council of Trent or CCL from 1918. Isn’t that odd?

Just because I don’t want to be accused of anything…what part of this is “bull”? BTW, I don’t think I quoted any canon law in this thread. I posted a direct quote from the protocol that Lefebvre signed which actually showed that the marriages were considered invalid even before the excommunications. Do you have something from the 1918 canon that contradicts this? I believe the 1918 code also calls for priests to have jurisdiction to confer this sacrament.

And what exactly in my post/posts do you think contains modernist thinking?
 
First of all… one doesn’t need a priest to get married… the priest is only a witness. Thus protestants can get married outside the church and the marriage is valid.

All it takes a bride, groom, two witnesses, the true intention to get married and the proper words… infact I don’t think you actually need to even be present…

(e.g. marriages in Nazi prison camps where men and women were seperate… not sure on that one though)…

You marry your bride/groom.

Canonically one requires an official witness from the Church (bishop, priest, deacon as ordinary witnesses and, under certain special conditions, the bishop can appoint a lay person). Catholics are bound to canonical form (and have been since before the 1917 codex iuris under the laws of Justinian). As such, they do require an official witness, and that witness must have competence to be a witness. That competence is granted by the local ordinary or the pastor of the church where the marriage is to take place. If this is missing the marriage is invalid due to lack of canonical form.

When couples married by the SSPX, SSPV, CMRI, etc. reconcile with the Catholic Church the usual process is a radical sanation granted by the bishop. This indicates that the marriage was invalid but was retroactively validated.

SSPX priest are valid priest, no? If you say no then what about priest that left the Novus Ordo church and went to the SSPX and then married you… such a delima… or a priest that was ordained my LeFebvre himself… He was a vaild bishop.

Why is this such a big dealy to the N.O. church? Actually I don’t think it is… if it was then you would rarely see Catholics marrying protestants. You would see and hear the bishops doing something about it. And don’t tell me they are because you know as well as I that they aren’t.

This is only a way to distract people from the real issue and that is the errors in the church and the fact that nothing is being done about it.

The Priest is a valid priest, that is not the issue, but he lacks jurisdiction that can only be given by the local ordianry.
Were you aware that there were issues with the jurisdiction of the priest who witnessed your marrige when you were married? If not, “common error” might allow the Church to supply the lacking jurisdiction and make the sacrament valid. This is far from clear though, as the schismatic nature of SSPX might put it outside of the bounds of “ecclesia supplet.”
As for Catholics marraying protestants, that requires a dispensation to be valid.

And canonically, if a couple believes they cannot in good conscience approach a priest with “normal faculties” to perform the marriage, then a marriage before witnesses is fully canonical and valid. I happen to know that this is how the SSPX “does” marriages these days. The priests are not official representatives but bystanders until the marriage is accomplished by the parties in question and then the priest blesses the marriage. Sure, it’s a legalism, but it’s a legalism done for the benefit of the couple and future children so that one of the partners can’t later decide they can leave the marriage – kids and all – because they’ve had the epiphany that “it was never a valid marriage anyway.”

Actually, no, it would not be all right since you have legal obligations to them from a civil standpoint.

They are valid priests but as soon as they are ordained they are suspended a divinis because of the irregular status of their ordaination.

If the SSPX wouldn’t call itself “Catholic” it would not be a big deal and the Church would treat them as if they were in the same class as the Orthodox

Errors? What “errors?” Since an ecumenical council cannot teach error there are no errors from Vatican II. To claim there are is to deny Church teaching and to throw the entire history of the Church into question.

AS far as the Catholic Church is concerned, the marriage is invalid when celebrated in this fashion – lack of form is the canonical reason.

I don’t think the Church is going to penalize persons who have married in the SSPX.

This whole thing is annoying to read when as a Catholic you can marry a Protestant and its fine, but we are worried about this?

I am not worried about it.

This is wishful thinking on the part of SSPX.

Can. 1116 §1. If a person competent to assist according to the norm of law cannot be present or approached without grave inconvenience, those who intend to enter into a true marriage can contract it validly and licitly before witnesses only:

1/ in danger of death;

2/ outside the danger of death provided that it is prudently foreseen that the situation will continue for a month.

§2. In either case, if some other priest or deacon who can be present is available, he must be called and be present at the celebration of the marriage together with the witnesses, without prejudice to the validity of the marriage before witnesses only.
There is no danger of imminent death, and not liking a priest with jurisdiction does not count as grave inconvenience. And §2 negates that reasoning. A priest or a deacon can always be found (at least in the U.S.). And the fact that the SSPX try and come up with such convoluted ways around what is a clearly black and white issue makes me think there are few times when “common error” would allow for “ecclesia supplet.” I just don’t think any couple would accept that it is usual for a Priest to only be there for blessing and not for being an official Church witness. If they think something in unusual, then there is not perfect ignorance, and there cannot be common error

I am not worried about it.
That is a straw man. You need a dispensation to marry a non-catholic or someone outside of the Church. (Can. 1118 §1, §2, §3) And, yes we should be worried about this. These Priests are lying to the couple if they tell them it is fine, and the couple is not truly married if they know the priest is in an irregular state.
 
What are the canonical requirements for form?
The canonical requirements are that one be married before a bishop, priest or deacon who has faculties (delegation) to witness the marriage and that the marriage take place in a church, chapel or oratory. Bishops have delegation anywhere in their diocese, priests and deacons generally receive delegation for the parish to which they are assigned. If they are asked to perform a marriage elsewhere then they get delegation from the pastor in whose territory the marriage will take place.

There is one exception to the bishop/priest/deacon requirement. If there will be no cleric within 30 days the marriage may be witnessed by a lay person appointed for this purpose by the bishop and, when a cleric is available, the nuptual blessing given.

I’ll lodge a friendly wager.

If the Vatican ever reconciles with the SSPX, and agrees to denounce Modernist error, then, at that time there will be zero marriages from SSPX chapels being re-done, and zero confessions being re-heard.
