Sticky situation after hiring family member

Hello~
My husband and I are struggling over how best to handle a situation that recently occurred after hiring our 21 year old nephew to help us complete a huge to-do list in order to prepare our rental between renters. Tasks that we wanted help with included yard work, exterior painting, appliance updating, hanging new blinds, etc. We had also slated a new roof to be done by a contractor well-known to us, but to be done in a month or so.

First day our nephew shows up to “work”, he has his girlfriend with him. He tells my husband “it’s kinda’s unprofessional, but I just like having her with me.” OK, fine. Right away, nephew sets sight on getting the roof job for himself, although- we’re not aware of exactly what experience he has and this would require us to buy all of the roofing tools necessary to do the job and then he would keep the tools (roofing gun and pry bars, etc) as part of his payment. My husband tells him that we just want a roofer who can show up and do it in a day or two and that he wouldn’t have the time to help nephew do the roof. .

So, eventually my husband asks him to take the truck and go get a load of dirt to fill in unlevel areas of the back yard. They come back, after much longer than you would expect it to take and he begins shoveling dirt. His girlfriend was with him and would occasionally help him wheelbarrow a load over, or rake dirt out here and there. Meanwhile, Nephew is insistent on convincing my husband that he should hire him to do the roof because he worked for a roofing company last summer… it starts to feel very distracting from the tasks at hand because he’s standing around talking while he’s “on the clock”.:mad: He works for a few hours that first day and ends up taking our car home for the night so that they don’t have to borrow his girlfriend’s dad’s truck the next day.

More of the same the next day- her hanging around him and occasionally getting him a tool or a drink, etc. He tells my husband that he had his girlfriend “clean out your car for you” last night. Ok. ??? My husband sent him to the store to get brackets to hang a few window AC units… Nephew says he wants to know if we have the money to buy the roofing tools while he is out. I tell him I’m not sure what we’re doing about that, and if we go that route I’d like to wait until after pay day. A couple of hours goes by and he starts calling my hubby asking questions about the roof and what kind of shingles we want to go with, yada yada yada. Hubby asks him to just get what we asked for and come back- we had lots to do and the tenants were going to start moving in the next day. THREE HOURS later, he comes back with the AC brackets and some roofing removal blades and plastic sheeting or something. TRYING TO GET HIS FOOT IN THE ROOF DOOR:cool:

The next day he returns with girlfriend and tells me she’s bored and if there’s anything she could do to help, just let him know. He says she already cleaned hubby’s car out, she can help clean our house or whatever. I felt uncomfortable, not really wanting to ask a stranger to clean anything for me but I tell him that if she’s really bored she can clean out my van. He said, “Ok, I’ll have her do that. She needs money for school so that will be good.” ??? I figure, whatever- I’ll give her $20 or something to clean my van. Fine.

Today, hubby stopped by Nephew’s place after work to go over his time sheet and settle up with him. Nephew informs hubby that they are expecting his girlfriend to get paid the same number of hours as him! We don’t even feel like he honestly earned the $10/hr wage we agreed to for him since he never really stuck to what we wanted him to do. He worked 4 days and was constantly disappearing- my friend who was helping as well (for free) on the 4th day kept catching him and girlfriend making out in the garage, the bedroom, etc. He spent a lot of time bending hubby’s ear trying to get that roofing job which was totally irritating and distracting.

Can anyone help with how to best handle this? Do we pay the girlfriend a token amount? What do we say to Nephew?

This is what should have been said on day one: You’re fired!

Needs to be said today: You’re fired!

Lesson learned: Never hire anyone you would be hesitant to fire.

No, you don’t pay the girlfriend anything. You didn’t hire her. Fire the nephew.

This. You never agreed to “hire” the girlfriend.

Hindsight is always 20/20, of course, but in retrospect, I’m sure you’ll agree you should have put your foot down that first day.
 
Since you didn’t hire the girlfriend, and he brought her along to help, he should pay her out of his wages. In a sense he sub-contracted her.

As for the roof. Get a roofer. The job is too big for an inexperienced and irresponsible kid and God forbid something happens…
 
IMHO the charitable thing to do would be to pay the nephew for the actual hours he was on the job, pay the girlfriend for the actual cleaning she did (you did agree to hire her, albeit reluctantly), and inform the nephew you no longer require his services, thanks all the same.
 
My opinion is fire him, and pay him for the amount he worked, and don’t pay the girlfriend, because you did not explicitly contracted her, and remind him that he brought her without you consent.

In addition, if you paid for the unwanted roofing supplies I would decide whether it is worth it to take them out of his paycheck or not.

My husband mentioned this idea of telling Nephew to pay her out of his wages as we were discussing last night… It seems logical to me, and possibly the right way to go about it. I think we should pay her for cleaning the van- but I don’t know how much. She only partially cleaned half of it- she didn’t even wipe anything down, just took out the junk and vacuumed the first 2 rows. The amount of work she did would have taken me about 20 minutes. She spent about 4 hours dilly-dallying on it.

And, fwiw- I agree with all of you who have said we should have shut it down Day One. It’s so hard to do business with certain family members, so we’ve learned.

I agree that you should pay her for cleaning the van ($20 seems reasonable, if not too much even for what she actually accomplished) and then allow him to take whatever he thinks is reasonable out of his own pay if he likes. You have already let him get away with quite a lot, so he should be grateful you are even paying him as much as you plan to.
 
Let him know you had budgeted x amount of money for his work ($10 x hours he worked) thus had only contracted him at that rate for those days. He is free to divvy it up how he wishes with his gf that he decided to bring along (that was not part of the agreement). And then pay her for the van work to which you agreed (although I understand his way of getting that work for her wasn’t the most forthcoming). I agree that $20 sounds reasonable for what you described (probably too much, but for the sake of appeasement).
Then thank them both kindly and let them know you don’t need them any longer (were there any days left on what you were wanting him to do, I know you mentioned your tenants were about to move in?)

With a national unemployment of over 7% the problem is not finding people, it’s finding people who do NOT behave like this nephew :eek:

I think we have been TOO generous and are looking to reign this situation back into reality for him without causing a family feud. He is not a good fit for us, since he thinks that the odd jobs are beneath him and he can only set his sights on the roof because frankly, he sees $$$$$.
 
The roofing should be done by a licensed contractor who will, by law, cover any problems that could arise.

When we hire relatives it is necessary to have a strong rule from the get go. I know how you feel, but letting him go now is your best option. The gf is his sub-contractor and it is his responsibility to pay her from his wages. The van is your responsibility, the amount you would pay her for that job should have been agreed upon before she did the job.

Now, not later, is the time to let him go.

Precisely. Your hubby is a softy, I’m sure he’s very lovable, but those lovable traits are a two-edged sword.

Nephew needs a big reality check. He should have been sent packing, day one, when he showed up with his girlfriend.
