Columbus, Ohio, Jun. 29 (LifesiteNews.com/CWN) - The Life Legal Defense Fund, a nonprofit legal organization based in Ohio, on Tuesday released a comprehensive study analyzing the current status of state laws on abortion and what would happen if Roe v. Wade and Doe v. Bolton , the cases that legalized abortion throughout the country in 1973, were to be overturned.

The study concludes that only seven states (Arkansas, Louisiana, Michigan, Oklahoma, Rhode Island, South Dakota, and Wisconsin) would have enforceable laws on the books that would ban abortion. These states represent less than 10 percent of the US population. For the rest of the states, new legislation would have to be adopted, or significant state case law precedent would have to be overcome. . . .

I think it’s very important for people in the pro-life movement to keep this in mind. Technically and legally speaking, Roe did not “legalize” abortion – it invalidated state laws that banned abortion. If and when Roe is overturned, (God willing!) the legal authority to ban/regulate abortion will devolve to the states once again. It will not be one national struggle then, but 50 state-based ones. Just something to remember.
 
It would bring it a step closer- no matter how small- to making abortion illegal altogether.

I can see Rhode Island and Wisconsin either not enforcing or repealing those laws.

Which states would ban it?
 
There is no question that it is true that this is the current law in most states. Overturning Roe is,never the less, a step toward making a change for the better.
It would also be a way of stating that it is just plain wrong to kill defenseless human beings. It is always right to state that evil is evil. There would be a moral statement made.
Also, we must remember that we cannot expect to make any progress with changing state laws unless & until we first change the federal law. Until then, we will only see state attempts at limiting, & ultimately ending, abortion turned over by the federal courts.
 
Oh we will probably never get abortion to be totally illegal. We should still TRY.

I for one would be happy to shut Planned Parenthood up and keep them from advertising their propaganda and filth to our kids.
 
It will still be an important legal victory in favor of states having the power to legislate independantly on this issue as they do with other issues.

Also, some states that do not impose an overall ban on abortion may still vote to place restrictions on abortions.
 
My husband has looked it up, and he says that MOST states would AT LEAST have abortion illegal after viability. Which is a heck of a lot better than now where it is legal everywhere in the U.S. until the child takes a breath (and some have even gotten away with it after that)!!!

Exactly!! I sometimes become deeply frustrated with trying to explain to people that every restriction that we place on abortion** saves lives**.
I know that it looks like a compromise, that there would still be abortions… There wouldn’t be as many! This can only be a good thing.
You know one of my own pet peeves? There is actually some opposition from some prolife people to a law requiring that the unborn child be given painkillers before the abortion is performed. I do not understand this. Why is it wrong? At least the baby will not feel itself being sliced/burned to death. And the very fact that painkillers are required has got to wake people up to the fact that these are real people, not “blobs”.
If I could shut down the abortion mills tomorrow, I would. I can’t. But I can press for every single restriction that is passable.** Every such law that is passed, means that more babies will live…**
Isn’t that the point???
