WASHINGTON (CNN) – The Supreme Court announced Tuesday it will consider limits on anti-abortion protesters outside clinics in the fall.

The court said it will hear an appeal over a 20-year-old campaign against abortion providers. At issue: whether federal laws against racketeering and extortion can be used against those who, according to the official court filing, organize “sit-ins and demonstrations that obstruct public’s access” to medical clinics.

Abortion rights supporters say those laws were the only solution against what they call dangerous, often violent behavior aimed at those seeking or providing abortion. They filed suit in federal court more than a decade ago.

Operation Rescue argues that the case is about free speech and the right of assembly. Jay Sekulow, head of the American Center of Law and Justice, which is representing anti-abortion groups, accused opponents of prolonging a “meritless marathon” suit.

Violent behavior, my you know what!!! I participated in two Rescues, prayed and sidewalked counseled while I was in college, and the only violent behavior I saw was on the part of the pro-aborts and the police.

Even if someone is violent, so what? Doesn’t mean others lose their free speech rights. “Activists” on the left sure don’t have this happen to them. Remember when protesters tried to burn down Seattle during the WTO meeting? A.N.S.W.E.R. helped organize it. The leader of the group, Brian Becker, bragged about what a great job they did. In 2001, A.N.S.W.E.R. members, protesting Bush, climbed up on the Navy memorial in D.C. and tore down the American flag.

Today A.N.S.W.E.R. leads the antiwar movement. Leading liberals speak at their rallies. ASFCME locals attend their protests (our government workers at work).

Another group at Seattle was RUCKUS. They climb buildings to put up banners and try to “throw a wrench in the machine”. Ted Turner has funded them. They build scaffolds and train for protests at Elaine Broadhead’s Maryland estate (JFK and Jackie’s hide-out when they were in the White House).
 
Lisa, has your group consulted with the DA about what they can do as citizens when they are assaulted? Putting your hands on someone is battery. Pushing someone could be interpreted as battery with intent to cause bodily harm, depending upon the circumstances.

Digital cameras with video capability are very reasonably priced, these days - it would be well worth it to pool resources and buy one and make sure that several in your group know how to use it.

Sounds like your little Santeria demon is intimidated, as well she should be with her pathetic little pantheon. 😉

Video cameras in evidence would possibly convince her to keep her hands to herself. And if they don’t and she doesn’t, they would provide evidence that she has committed assault and battery.

It wouldn’t surprise me a bit to see the Supremes do a number on the first amendment after their recent attacks on the right to own property. If you go to jail, though… you’ll have a lot of company.

All hell will rejoice on such a day, will it not? That peaceable people of conscience go to jail while the murderers continue to profit from their gruesome massacre.

It is amazing how they will zero out the pro-lifers about violence and ignore other groups like PETA among others when certain members of their groups become violent.They want to shut us up:mad:

For using RICO against pro-lifers? Against using it?

If the appeals court ruled no to RICO…that isn’t good.

Hidden cameras are best - we have a local pro-lifer who drives a large truck with graphic images on it to abortion mills. He follows the law but as you may guess he gets harassed big time. He thought a camera would work, but he’s been assaulted publicly with his camera - I’d keep it hidden.

BTW - I wonder if the SC will hear testimony about how the pro-choicers have lied about “attacks” and have sat in vehicles during the times they were supposedly assaulted?

I have seen them lie too:nope: It makes you wonder if they send the so-called pro-lifers in to attack:confused: It makes me wonder.Are these misguided pro-lifers or are they being sent to make us look crazy???The death movement is so radical and shady I wouldn’t put it past them:nope:
 
Researched the case and this is good for the pro-life side as far as I can see. Our side wants the Supreme Court to lift an injunction .

This is probably why CNN did not report the facts of the case in the article posted above.

Nature of Case: National Organization for Women (NOW) sought to use the federal Racketeer Influenced and Corrupt Organizations (RICO) Act to sue anti-abortion organizations…The U.S. Court of Appeals for the Seventh Circuit had ruled that the case could not go forward because RICO applies only to activities that are motivated by economic gain, which could not be demonstrated in this case.

Holding: The court overturned the appeals court decision, allowing the lawsuit to proceed using RICO as its basis . . .

After the Supreme Court held the suit could proceed even if the anti-abortion groups were not economically motivated (see 1994 ruling), the case was remanded to the lower courts for further proceedings. A jury found defendants had violated RICO by committing extortion, and the district court entered a permanent nationwide injunction prohibiting defendants from threatening clinics, their employees, or their patients . . .

Holding: The Supreme Court reversed, finding that because defendants did not acquire property, their actions were not extortion. Therefore, the jury’s finding of a RICO violation was erroneous and the injunction was reversed.

In 2003, the Supreme Court ruled that while anti-abortion groups did commit crimes and interfere with clinic operations, the lower court’s injunction could not be supported by these acts of extortion because no money or property had been obtained from the clinics as a result. The Supreme Court sent the case back to the 7th Circuit Court of Appeals for further action, where NOW argued that even if defendants’ acts of extortion were not covered by RICO, their acts and threats of physical violence were.

The 7th Circuit Court did not decide that issue, instead sending the case back to the district court to hear arguments and make an initial ruling. The defendants then appealed to the Supreme Court, demanding that the injunction be lifted without further proceedings in any other court.

“Of course they want to have the injunction lifted,” Gandy said. “They want to return to the days of using physical assault to terrorize patients and providers as a way to shut down these clinics. But even if they win, they won’t be able to do that–if they return to the violence we will pursue them under the Freedom of Access to Clinic Entrances (FACE) Act.”

 
Wow - good info, thanks for posting. Just a s(n)ide note…how about RICO for the abortionists? We all know they make cash money hand over fist and a lot of it isn’t even reported to the IRS. :mad:

What’s her first name - I want to get some of us to start praying for her Repentence and Conversion.

She’s doing what she’s doing not just because you’re effecting her income, but because she’s “Under the conviction of the Holy Spirit”. I’ve never known anyone to respond as violently as you’ve described, esp. towards children, unless God was doing some heavy work on her.

Lisa, if she’s lashing out at children, then her conscience knows that she is killing children, and she’s doing everything she can to shut it up.

Lisa, when she gets violent, pray the prayer of St. Stephen the Proto-Martyr out loud, and make sure she can’t get near the children.

And, could you please tell us her name so we can pray for her conversion NOW?
