The husband the head of the wife?

But a spouse should not make those judgments apart from the Church’s affirmation.
Are you suggesting a spouse cannot judge adultery or abuse as wrong without the Church getting formally involved in some way?
 
What do you mean by “judge”?

The Church already judges adultery/abuse as wrong.

Judging actions is one thing. Judging the person is different.

Jesus does not judge the contrite.

Judging means “casting out”

Not exactly. The Church can judge a person, without ultimately judging their soul.

Only God can judge a soul.
 
1 Corinthians 5

For what have I to do with judging outsiders? Is it not those inside the church whom you are to judge? God judges those outside. “Drive out the wicked person from among you.”

Ok. Not sure where this is going.

But here is a more concrete example. In a situation where a husband has abused his wife, and she leaves him, he may very well be contrite and manage to convince a priest he is contrite. Both he and the priest may attempt to persuade his wife that he is ready to resume marital life. She is well within her rights to judge otherwise, since she is likely to know more realistically than the priest how often the cycle of abuse and contrition has been repeated in their marriage.
 
But you are not acknowledging the situation where the wife is also unfaithful and abusive.

Do you suppose, O man, that when you judge those who do such things and yet do them yourself, you will escape the judgment of God?..
you then who teach others, will you not teach yourself? While you preach against stealing, do you steal? You who say that one must not commit adultery, do you commit adultery? You who abhor idols, do you rob temples? You who boast in the law, do you dishonor God by breaking the law


You see? The Church will not approve of hypocrites judging.
