The case involves one of the three gay, married Catholic school employees fired in the last year at the direction of the archdiocese.

“The First Amendment to the United States Constitution protects the right of religious institutions and people to decide what their beliefs are, to teach their faith, and to associate with others who share their faith,” said the U.S. Department of Justice.

It is not legal ruling, but an opinion that the court could ignore.

The irony about this whole situation is that the current U.S. government is supporting the Indianapolis Archdiocese when it comes to its issues with employees in gay marriages, but there is a very real possibility that the Vatican will step in and deliver a rebuke to the Archbishop by overturning his directive that the one Jesuit school cannot call itself Catholic because they refuse to fire a teacher in a gay marriage.
