I don’t get it? Does the church structure, itself, sit on the US/Mexican border? How does it violate religious freedom?
No on street parking could also violate religious freedom…

It’s an pro-illegal immigration argument using the First Amendment as cover. From the article:
The court battle began when Diocese of Brownsville Bishop Daniel Flores said no to the government’s request to enter the acre property for the purpose of surveying to determine its suitability for a wall site. Flores based the rejection on Catholic teachings to accept and embrace refugees and asylum seekers

The argument seems sound. The Church is trying to stop their sacred ground from being used for purposes antithetical to their religious beliefs. I think the idea of eminent domain will prevail, but it probably shouldn’t considering this is a Catholic Church and an important historical site. One of my problems with the Trump wall has always been that it is easier to tear up someone else’s yard for what you want than to offer your own. A New Yorker coming in to deface Texas just hits me as wrong, especially when there is no push for a wall on his own state’s border.

Hi PNewton,
The push for the wall in the southern sector may be due to the discrepancy in quantities of illegal immigration one finds when comparing the two borders. The following pdf is from the U.S. border patrol.

Among the information shared is number of apprehensions, pounds of marijuana and cocaine seized, assaults, deaths, accepted prosecutions, rescues and agent staffing. While the southern border, in 2017, had roughly 8 times the number of border agents as the northern border, roughly 300 times the number of illegal entrants were apprehended in the south. The southern border is roughly 1/3 the length of the northern border. It seems sensible to concentrate efforts where they may be most effective.
