Have there been any recent developments on this story? Was Msgr. Dale Fushek found innocent?

I don’t know but that was the only witness we had against Paul Shanley, one of the worst abusers in Boston.

The legal system relies on “common sense” (which is not always reliable) rather than empirical studies. (For example, polygraph tests are still used and are admissible evidence in a court of law- yet they have not been proven to work). Recovered repressed memories *shouldn’t *hold up in a court of law, because there’s too much of a chance for them being innacurate, or integrating what they have been told happened to their actual memory.

Where are they used in court? I thought law enforcement and the security apparatchniks were the only fools to still use polygraphs, which as you say are not reliiable at all and have runined many peoples careers.

MANY people will debate this with you. (I agree with you)
It is still being used by the Psychiatric community. That is a pity.

My sister used it. It did not bring any good to our family.
 
Tell someone to look for water and they’ll go to the ocean.
Tell them to find anything, and I doubt it will be water.

Polygraph test results are not admissable in a competent court of criminal jurisdiction. They can be used in internal disciplinary proceedings in many places. They rely on physical responses to stress and are incredibly unreliable. About the only thing they can point to with any degree of accuracy is nervousness.

Repressed memory recovery enjoyed a time when it was popular. However the current thinking is that it is way too subjective for use in criminal cases. It is still trotted out but is not given much credence. It was found that most people who discovered repressed memories were in fact highly susceptable to suggestion and that the memories were overwhelmingly planted by the therapists and examiners involved.

Polygraphs are not admissible in court…mainly because the results are only as good as the examiner.
 
I am sitting here in Portland, OR, where we are having similar difficulties. Many priests have been accused of molesting children. Some have been exhonerated. Others have been found guilty. Unfortunately the exhonerated don’t make front page news. I see that praying for priests both innocent and guilty to be my only choice. God will sort things out and give strength where needed.

The fast that he consistently denied the charges proves nothing as most criminals never admit their crimes. If he is guilty he deserves his punishment along with the other pedophiles that have shaken the Church to its core . 👍

That being said, if the only evidence against him is the resurfacing of repressed memories and polygraph test results as has been rumored, I would be hard pressed to find him guilty beyond a reasonable doubt. Why? Repressed memories are very unreliable, much more so than most people would believe . In fact normal memory is highly unreliable. We tend to remember good events as being better than they actually were as well as bad events being worse. Recovered repressed memories have in many cases been found to have been planted by the interviewers, perhaps unintentionally, by the questions asked.

Polygraph tests are EXTREMELY unreliable at detecting anything other than changes in heart beat, changes in blood pressure and sweat, which for normal people indicate stress or nervousness. For people with truly pathological personalities, they are of no use whatsoever as these people don’t have the same psychological reaction to stressful questions as do normal folks, by and large… That is the reason they are not admissable as evidence in courts of competent criminal jurisdiction. They do have one group of staunch supporters though, their manufacturers and those who are trained to use them. 🙂 No one else places much value in them or their results for criminal cases.

There is always this kind of negative “fallout” – Fr. Maciel and the Legionaries have been going through the same thing. The guiding rule in these kind of situations are two:

Innocent until proved guilty. Evidence must be presented and weighed for credibillity.

As adult Catholics we must learn to separate the wheat from the chaff. We don’t reject the Christian belief because we are faced with flawed humanity who used, abused or served poorly. It is difficult and much prayer is needed for all concerned. Teens OTOH lacking maturity in many cases attach themselves more to “persons” – this is going to very hard for them.
 
Yes, very hard for them. The Catholic church can’t afford to keep loosing people. Especially teens. 85% of my Catholic friends lost the faith after high school and in school only did it because school made them and their parents made them. There wasn’t anything to keep the teens involved. Life Teen… regardless of its questionable masses… still keeps young Catholics involved in the church… and hopefully keeps them in the faith after they’ve grown up.
