What do I do about a Divorced Protestant marrying my Cradle Catholic niece?

I have a cradle Catholic neice who will marry a divorced Protestant. Does he need an annulment so they can marry in a Catholic Church?
They are contemplating getting a minister to “witness” the justice of the peace marry them. Will she still be able to attend Mass and receive Communion?
I am also concerned about whether I should attend the wedding. What options does our Catholic Church offer to those in this situation?
