what an interesting interpretation of the constitution you briefed. why don’t you take the real world step and actually test it it court, which is the only place where such opinions matter.
Some things are more simple than we try and make them out to be. I don’t need a Constitutional scholar like Barack Obama to tell me Roe is ‘effectively’ established law, or AG’s like Gonzales to say Congress ‘Authorization to use Force’ in Iraq is a legal war.
It isn’t a matter of interpretation; it is clearly written. Those that want to interpret:
Article 1 - The Legislative Branch
Section 1 - The Legislature
-**All legislative Powers herein granted shall be vested in a Congress **of the United States, which shall consist of a Senate and House of Representatives.
Section 7 - Revenue Bills, Legislative Process, Presidential Veto
-Every Bill which shall have passed the House of Representatives and the Senate, shall,
before it become a Law, be presented to the President of the United States; If he approve he shall sign it, but if not he shall return it, with his Objections to that House in which it shall have originated, who shall enter the Objections at large on their Journal, and proceed to reconsider it. If after such Reconsideration two thirds of that House shall agree to pass the Bill, it shall be sent, together with the Objections, to the other House, by which it shall likewise be reconsidered,
and if approved by two thirds of that House, it shall become a Law. But in all such Cases the Votes of both Houses shall be determined by Yeas and Nays, and the Names of the Persons voting for and against the Bill shall be entered on the Journal of each House respectively. If any Bill shall not be returned by the President within ten Days (Sundays excepted) after it shall have been presented to him, the Same shall be a Law, in like Manner as if he had signed it, unless the Congress by their Adjournment prevent its Return, in which Case it shall not be a Law.
Section 8 - Powers of Congress

Article. II. - The Executive Branch
Section 2 - Civilian Power over Military, Cabinet, Pardon Power, Appointments
The President shall be Commander in Chief of the Army and Navy of the United States, and of the Militia of the several States, **when called into the actual Service **of the United States;
Article III. - The Judicial Branch
-The Trial of all Crimes, except in Cases of Impeachment, shall be by Jury; and such Trial shall be held in the State where the said Crimes shall have been committed; but when not committed within any State, the Trial shall be at such Place or Places as the Congress may by Law have directed.

When our elected/appointed leaders break the law, using the law to correct it is difficult and may require extraordinary means to bring about the law.
