Freedom to Marry testimony is used for someone who wishes to be married according the laws of the Catholic Church and there is not direct evidence of their freedom to marry.
If someone is a Catholic then when they are married their marriage is recorded at the parish in which they are married and it is recorded alongside their baptism record. When a Catholic wishes to get married they must obtain a recently issued copy of their baptismal information. On that certificate will be whether or not the individual has ever entered into a marriage or if so, if they have an annulment. So the only time such testimony would be required for a Catholic is if its impossible to get access to their baptismal information.
Protestants don’t normally have that information recorded with their baptismal information. So in order to establish their freedom to marry thhe testimony of witnesses who can attest that they have never been married before is required.
