Can a person annul his civil marriage and remarry through church wedding? In civil marriage, are the couples recognized as husband & wife before the eyes of God?

The Church recognizes as valid marriage, a marriage between non-Catholic Christians.

However, if a Catholic marries outside the Catholic Church in a civil marriage, that marriage is not valid in the eyes of the Church. A person would need to speak to their priest about what needs to be done if they have an invalid civil marriage, and want a Sacramental marriage. If they wanted to validate their marriage they would need to obtain convalidation or Radical Sanation.

A. 5. The Catholic Church, according to the Canon Law, provides three main reasons as to why a true and valid marriage did not exist in a previous union. Those reasons are:

a. There was a lack or defect of what is called “canonical form.”
Code:
All persons who have been baptized in the Catholic Church, or who have been received into the Catholic Church after their baptism in another Christian denomination, and who have not left the Catholic Church by a formal act, are bound to "canonical form." Canonical form means that the parties were married in the presence of a properly delegated priest or deacon and two witnesses, following the rites of the Catholic Church.

Therefore, if a Catholic decides to get married before a Justice of the Peace or before a Protestant Ministry without first obtaining permission (called a dispensation) from the Bishop of the Diocese, then that marriage is not valid according to the Catholic Church because of its "lack of form."

If you mean obtain a civil annulment, no that has no impact regarding their marital status in the Church.

Yes, in general.

You do not specify if you are talking about Catholics, non-Catholics, or a Catholic marrying a non-Catholic. So the answer might vary slightly if we are talking about two Catholics who marry outside the Church.

A civil annulment has no direct impart on the validity of a marriage. However, the issues that allowed for a civil annulment may be still be applicable apply to a church annulment.

Hi,

Thank you very much for your replies. Just want to specify that both the man & woman are of legal age. Both catholics & both decided to get married civilly. After a vey short time, it turned out the lady got into a misunderstanding with the in laws & was disliked so much so the man, being convinced by his parents & siblings, decided to annul his civil marriage with the woman. Now the man found someone else. Can he marry another one before the Catholic church? Isnt his civil marriage recognized as valid before the eyes of God? Isnt this adultery? I dont think the reason for the annulment of his civil marriage falls under any of those enumerated in grounds for annulment - catholicdoors.com/faq/qu79.htm. Please reply. I really need enlightenment on this. will be very grateful.

Thank you very much!

Yes.

No.

Catholics are bound by Churcch law to marry in a particular way. Two Catholics who marry civilly and not in the Church are not validly married. To become validly married, they would have had to go to their priest and exchange vows before the priest nd two witnesses. This is called a convalidation.
Isnt this adultery?
No.

An annulment process examines a marriage that is presumed valid to see if there are any reasons it might not be valid.

The situation you describe involves two Catholics who are not married validly at all. So, no, there is no Church annulment process.

Sounds like the woman did not follow Church law to marry this man. She should go to confession and talk to her priest. She should approach her pastor for marital counseling if she ever wants to be married in the Church. And she should count herself lucky to be rid of this man that she married civilly.

What you describe, if accurate, would not be a valid civil marriage, as Catholics must marry according to church law. I urge caution, as people often miscommunicate or sometime outright misrepresent key details that could complicate matters.

Hi,

Thank you very much! You just gave our lives direction.👍 Have been trying our very best to put GOD first always in everything. I am taking seriously what the Bible says about the Blessings of Obedience ( Deuteronomy, Leviticus & in Joshua, chapters 28, 26 & 23 respectively).

To GOD be the glory!

I used to be “married” through a civil “marriage”. I knew in my heart that it wasn’t a real marriage since I’m a Catholic, and it wasn’t blessed in the Catholic Church. Another reason it could not have been blessed in the Church is that the woman I “married” was divorced. It failed, and I got an annulment through the Church. It was an open and shut case since it was clear that it wasn’t a valid marriage to begin with.
