Would any of you take legal action?

I didn’t say it was pointless - I was literally answering the question of what I myself would do. The poster, of course, has to decide if she has the time and energy to pursue this.
 
State law determines when your former employer has to give you your final paycheck. See

Thank you! This is good to know. Looks like in Michigan it’s the next payday. Next Payday is scheduled for next Friday, but he said he is going to mail a check, but I had asked if I could pick it up, as I need money and I don’t want to wait another week after that week to get in the mail. Is it illegal of him to not give me my paycheck the same day as payday? I’m unsure of this, but I contacted a couple attorneys today, so waiting for their response tomorrow.

Make certain they will not be charging you for your initial visit and will take this on contingency after that. You can’t afford to run up legal bills pursuing this.

Realize, though, that even if you do not file suit there may be options in terms of documenting his behavior.

Thank you! I know, I made sure to ask about a free phone consultation. I should expect a call tomorrow, as I left a voicemail for one attorney.

I am not letting this go. I don’t care if it takes up some of my time. I normally would let things slide, but not this time. Just wish I had him recorded or more proof, but I know I could get a couple or a few previous employees to back up my claim.
