Hello everyone! Would you all like to see a return to the Comstock Law that was enacted on March 3, 1873? I sure would! For those of you who don’t know what the Comstock Law was, here is a quote from Wikipedia:
Wikipedia:
The Comstock Act (ch. 258 17 Stat. 598, enacted March 3, 1873) is a United States federal law of dubious Constitutional validity that made it illegal to send any “obscene, lewd, and/or lascivious” materials through the mail, including contraceptive devices and information. In addition to banning contraceptives, this act also banned the distribution of information on abortion for educational purposes following the ideal of “Hear no Evil, See no Evil”. The sale and distribution of obscene materials has been unlawful in most of the American states since the early 1800s, and has been prohibited by federal law since 1873. The federal anti-obscenity laws are still in effect in 2008 and are enforced,[1] though there are extensive debates on what is “obscene”. Twenty-four states passed similar prohibitions on materials distributed within the states.[2] Collectively, these state and federal restrictions are known as the Comstock laws.

I would love it if we could see a return of the Comstock Law but I don’t see that ever happening. So, would you like to see a return of the Comstock Law? Please vote in my poll and discuss your reasons for why or why not you’d like to see a return of this law.

It was declared unconstitutional by the US Supreme Court, so a return would require an amendment to the US Constitution.

Good point. On a more practical note it is unenforceable given the internet. Much of this comes via spam. Many of the spam comes from overseas or people’s hijacked computers with viruses in bot-nets. It would also be a legal nightmare if you even thought if trying to update it for the present.
