yet another annulment question

A friend of mine who was raised Catholic married another Catholic. I’m not sure why, but they were married by a judge a few years ago. They recently divorced. So here’s my question: Since the first marriage was invalid, would they need an annulment if either party wanted to marry inside the Church?

Also, my friend no longer considers himself Catholic, but his ex-wife does. Would she be able to recieve an annulment without his participation?

Either person can start an annulment process. In this case it would not most likely be a full annulment process. A ruling could be rendered without the other party being involved.

If either person wanted to attempt Marriage again the Church would first have to determine that the prior Marriage was infact invalid.
