Hello:

Does anyone out there know anything about the YouTube to Mp3 Downloader website? I have wondered whether it is stealing or not, and the one whose website it is states that its filesharing, not stealing if you download a song not posted by the artist themselves. Therefore, it is legal, according to the site designer. Any thoughts?

If the stuff is copyrighted, then it is stealing, but if it isn’t copyrighted, then it should be fair game (unless otherwise noted in the video or its description).

I would proceed with caution.

Filesharing is legal unless the file being shared is under copyright and you don’t get permission from the copyright owner. So the info on the website is right and wrong at the same time. If the poster is not the artist but they have permission from the artist to post the song, then it’s OK. But if they don’t then it would be illegal. It doesn’t matter who you get property from, it’s who owns it that is important.

Personally I would go on the assumption that any artist who wanted to offer their work on the internet for free would post it themselves.

It is clearly a violation of the YouTube Terms of Service, section 5B.

“YouTube Terms of Service” said:
5B. Content is provided to you AS IS. You may access Content for your information and personal use solely as intended through the provided functionality of the Service and as permitted under these Terms of Service. You shall not download any Content unless you see a “download” or similar link displayed by YouTube on the Service for that Content. You shall not copy, reproduce, distribute, transmit, broadcast, display, sell, license, or otherwise exploit any Content for any other purposes without the prior written consent of YouTube or the respective licensors of the Content. YouTube and its licensors reserve all rights not expressly granted in and to the Service and the Content.

I use Atube catcher to put songs on my MP3 but now that Ive read the youtube terms I think I wont use it anymore it seems to fall along the lines of stealing
