“Michigan Catholic Conference spokesman David Maluchnik confirmed Tuesday that extending the statute of limitations is “of concern” to the church’s lobbying arm, but he withheld further comment until the bill’s impact could be fully reviewed. He said the group supports other parts of a 10-bill package introduced Monday, including a measure that would add more people to the list of those who must report suspected abuse to child protective services.”

uhm…
what is maluchnik concerned about?
is he really a representative of the of the Church? don’t mean to nitpick, but the article title rubbed me wrong.

“A … bill that … would retroactively extend the amount of time child victims of sexual abuse have to sue their abuser” is not something I’m against. trauma often clouds judgement for prolonged periods and memories can be surpressed to cope. that doesn’t mean legal justice shouldn’t be served…

thoughts ?

I agree, I believe the stsatute of limitations should be increased becasuse we now know that the young have a hard time coming forward and justice should be afforded them t o a certain degree as they get older and can more easily step forward that being said I do not believe this can be a retroactive law. It is one that must be made as we move forward in time. If it is retroactive it should certainly have a limit on that of nothing longer than 10 years.

As long as it applies to everyone, I’d be all for it. I seem to remember that some state (?) tried to extend the statute of limitations, but only for accusations against clergy. Or something like that. I hope someone remembers better than I do.

Yes of course it must apply to all cases of abuse of a minor. It could certainly apply to a chilid who becomes pregnant by an adult. Escorted to the abortion clinic. and sent back home with the person who did the abuse. All parties in this situation should be charged with the abuse of that child. The SL should be set to that persons age. Age of possibly 31 being set at where limitation is. so a 13 year old is going to have a longer SL than a 15 year old.

Well, I have to admit that having to sue for childhood abuse by the age of 19 is a remarkably short period of time, but the extensions they are proposing seem too long.

Among several reasons statutes of limitations exist is that after a period of time, the evidence has simply disappeared, exculpatory evidence has disappeared, and people’s memories are very dim.

Can you tell the police where you were on the evening of the 23rd of February, 2006? So if someone said that you had committed a crime at that time, how would you defend yourself?

I read about a very sad case of a women’s recovering memories and accusing her father of abuse during a certain time period. This split the entire family into pieces. Later, he found some records from that time period, and realized he had been away from home during that time, because his job had required he go out of the country.
