Nun ticketed for selling statuettes of Blessed Virgin outside San Jose parish wants her name cleared

Full article…
She should have taken out the permit like a good citizen.

If she had been merely soliciting donations, there might have been a case made for freedom of religious expression.

Even if she can prove all the money was being donated for charity? :o

Seems to me that she was not peddling, but fundraising. ?

She speaks French, so the “Spanish instructions” would not have been understood by her.

Further, if you read to the end of the article, it says that she had already stopped selling the statues anyway by the time that she was cited.

AND that the police refused to let her call her Mother Superior to ask for instructions when this whole thing came about.

So you have a situation of a nun selling statues on a feastday, unaware (in so far as the article states nothing to indicate that she had ‘refused’ to get a permit and by implication, did not know that she ‘needed’ one) of anything ‘wrong’ about the practice, not aware that she was in ‘violation’ as the ‘instructions’ given were not in a language with which she was necessarily familiar, and not given the opportunity to consult with her Mother Superior.

Since she speaks French, it is entirely possible that she is not even a citizen per se of this country. Was Mother Teresa (a native of I believe either Romania or Bulgaria) a citizen of India when she first went to the convent there? Are nuns from France or Germany who serve in convents in, say, the Congo or Zambia, citizens of those countries?

So saying that "she should have bought a permit like a good citizen’ might not be at all applicable in this case.

It will be interesting to see what happens. I certainly think that more data needs to be brought out though before anyone can make a truly informed OPINION, far less a legal decision.

Get over it, TE.
  1. Are you implying that religious should not be subject to the laws of their countries of residence?
  2. Her Mother Superior, or someone delegated by her to look after such things, should have made the necessary arrangements.
  3. No, it will be interesting to see what happens in the Russia/Georgia dispute and what happens when Iran gets nuclear weapons. This story is essentially a space filler.

Nothing to ‘get over’, bee, but thanks for the concern.😃

You gave your opinion FWIW, I gave mine, that’s all.

As Catholics I do think that we can disagree with each without making “remarks” of a certain stripe to those with whom we disagree.

Whether we **do, **is sometimes another story.

God’s peace to you.

It appears the district attorney agrees with you:

When the case came to court in May, San Jose City Attorney Rick Doyle dismissed the charges. “No jury or judge was going to convict a nun of a misdemeanor for selling statues of the Virgin, particularly not on the feast day of the Virgin de Guadalupe,” wrote Herhold.

Thank goodness, common sense finally prevails!

I wonder how much extra time one serves in purgatory for busting a Nun for selling statues of Christ’s mother?🙂
As an ex-policeman from back in the 1960’s I think I would have looked the other way. If it was done from following a direct order of a superior officer, the policeman could have his/her job on the line. What about the family they have a moral obligation to support. For the officer, thats being put between a rock and a hard spot. Lets just pray that cooler heads prevail and the case is actually dropped by the DA

It’s good to see wise heads prevail. if the cop acted on his own accord then i hope he hangs his stupid head in shame. if it was an order. i hope his boss is sacked for such prejudice behaviour

What the heck  According to the article they were personally warned, as well as being hailed over a loudspeaker system, to clear up. Two hours later they were still there. Seems to me she thought because she was a religious she was above the law and could do whatever the heck she wanted. So the charges get dropped but she’s still not happy - now she’s taking up legal time trying to get the charges completely erased

They should have thrown the book at her

Legal time mustn’t all that valuable if its so important to book a nun for selling some trinkets on a feast day…ticketed after she had stop selling them non the less.
No all this is a case of the cop wanting to act tough in front of the guys. sort of " hey look guys. I’m so tough i booked a nun, even though she had stopped committing the offence when i booked her"…No Mr police man you’re one of two things…
  1. You’re a little man making up for being picked on at school one too many times.
  2. You saw some criminal committing a crime. a criminal who looked too tough for you, so you decided you would act busy so you could ignore him. and that makes him a coward…
either that or some thin skinned atheist (aren’t they all?) was so shocked and horrified that they had to report this terrible crime to the officials and make sure this criminal felt the full weight of the law.
I hope they do fully clear her name. everyone has the right to have their name fully cleared when the law goes on like some over excited bully.

bolbing mine
As an ex policeman and the father in law of a police detective who just completed RCIA a little over a year ago, and who is going on retreat with me this fall, I don’t find these descriptions hold water at all. Particularly the atheist part. I have known policemen in my city to leave promising careers with the department and go into the seminary and be ordained. and are now pastors in large parishes.

That’s common to most people who are coward, they were tough to those people who doesn’t or can’t fight them.

Nowhere in the article does it say she was ticketed AFTER she stopped selling. What article are you reading? It says very clearly she was warned by loudhailer then warned in person and two hours later she was still there having refused to disperse. The cops were doing their job. The other traders obeyed the cops. She didn’t. And now she thinks she is something special and show get away with it as if it never happened.
I repeat - throw the book are the arrogant witch. 👍

O yes. they shouted at her via loudspeaker in a language she didn’t understand> Sorry i was wrong. but those actions makes it even more clear that the actions of the police were racist. (hey she is catholic, so she must only speak Spanish.)
as i said racist behaviour. deacon ed B . sorry i didn’t mean all police were atheist.
i re read my post. i meant that some thin skinned atheist called to make a complaint. (aren’t they all) part was about all atheist being thin skinned.
Agnostic. very funny calling the nun a witch. what are you 7?
