Wow…your letter said you have to pay up before you receive your annulment decree…my wife received her letter in the affirmative last month and the decree will be executed next week…she paid $200 to the tribunal and $300 to a special advocate…nothing about any more payments…that’s a tad harsh
Well that’s what we were told. The final letter will come early Feb.
 


I called the tribunal yesterday morning and they stated that my ex husband received the letter so that he would be able to appeal the sentence, should he desire. Being that im the petitioner, I dont need that opportunity, im guessing (being that they ruled in the affirmaive and thats what I was going for) so I didnt get one. …

My questions are: The office said that once the senetence is in effect, itll be effective in the TRIBUNAL, but that until we get the decrees, neither myself nor my ex can “act” so to speak, on the judgement. At least, thats how it sounded.
Is this true that we cannot date others licitly untill we have the decree, even though its become effective and our “marrying” parish has been informed our decree of nullity?
Whats the purpose of having the official document other than “proof”?
Will we have to supply the parish with the decree before attempting a marriage? …

Questions: I wouldn’t say that the Sentence is effective in the Tribunal but you can’t licitly act on it unless/until you have the document in hand. That’s a conversation for a faculty lounge, though. It doesn’t really matter as far as getting married. In practice, yes, you will need the document if/when you wish to marry in the Church (see c. 1085.2). It is proof that even though your civil record indicates a prior marriage, the Church regards you as free to marry. That’s the purpose. If you have the document, then you can present it. If you don’t, then the parish could ask for such a document from the Tribunal (I would think).

Dating “licitly” without the document? Well, there is nothing in the law about dating. It seems to me that if you are free to marry, you are free to date…even if you don’t have the ultimate document in hand.

Not sure what I think about the fee structure you mentioned…

The info my ex got was that the judge had ruled in the “affirmative” and that he had 15 days to view and appeal of he wished; the “publication of the sentence” letter. Since we’re both working on this together, he’s not appealing; hell just let the 15 days lapse, at which time it’ll become effective.
I never got this letter and when I called they said I didn’t get one.
They said the next letter would come once the 15 days ends, stating that the process is over. Being that it’s an affirmative, well get decrees but we cannot have those until we pay off the remaining balance we owe. My husband applied for and received a declaration of nullity from his first marriage. We received a letter from the tribunal during the first instance explaining that all the evidence was in, they’d published a decree, and hubby and his ex had a set amount of time to come and review the evidence. They also asked for the rest of the money owing at that time, as they had to send a portion of the fees to the appeals tribunal. (The declaration of nullity was granted about 3.5 years ago so a second instance was still mandatory.) Hubby later got another letter saying that the appeals tribunal had granted an affirmative decision, he could appeal to the Rota if he wanted (of course he didn’t), and if he wanted to remarry he could speak to his parish priest. Our marriage was convalidated a few months later.

I had hoped it would have arrived by now since it’s coming from a neighboring city upstate. 😦 I know nobody is as anxious as I am to get it but I think it’s been a reasonable amount of time and wanted to check in case anyone has had experience with this and can clarify/ease my mind.

When my wife tried to get a copy of her baptismal certificate she found out that the tiny Baptist church where she was baptized didn’t issue certificates…all it was …was about the size of a check…it took her probably a couple of months as the secretary at the church wasn’t very co-operative…she said as it was so long ago she would have to check right back through boxes of papers to try and locate it…she said she was too busy at that time and would try later…weeks went by and she never heard from her…my wife called again and got much the same answer…she didn’t have time and would get around to it when she could…weeks went by again…eventually my wife talked to a lady at RCIA who said she would look into it…she actually contacted the local Pastor who must have gotten onto the secretary because she had the certificate in just over a week…I had to also provide a baptismal certificate for proof of my baptism…I was baptized in Australia…I contacted the church and was told that all baptismal certificates from that period were no longer at the church and had been archived at the State Library…they gave me the phone number …I called them and they said they would in fact send me three notarized copies…no charge for going through the archives to find them…and no charge for mailing overseas…I had them within a week…and here my dear wife waited two months…and the big day arrives tomorrow…her annulment is executed …yahoo…I really hope you get yours soon…can you call them to find out if it has been sent…sometimes it pays to be pushy…good luck and God bless

2 months?! Your poor wife! Hearing your story makes me wonder if I need to call. I hate feeling pushy but this is a time sensitive matter as their are upcoming Rites for my imitation that I will be excluded from if I can’t get my paperwork handled. :confused: I will think I will call on Tuesday if I don’t hear from deacon by then.

My annulment was fairly straightforward (lack of form). It was less than a month from the time I completed the initial paperwork until I had the final approval paperwork in my hands. I knew a week earlier than that, too, because I received an email letting me know that it was done. I was shocked and elated, because I’d read how time consuming and slow the process can be.

My Baptist church actually faxed mine to me. Do you have a fax available? I received another copy in the mail about three weeks later. I would give them a call either way.

Thank you. It is nice to have some sense of encouragement! I know Lack of Form for a Catholic marrying outside the Church is usually fairly easy to file, and does not require the formal process.
Unfortunately, I find it’s us Non-Catholics that usually don’t get the luxury of that path. The majority of the converts I know have all had to face the long drawn out formal process of annulment. A lot of us don’t understand half of it and become very overwhelmed very quickly.

Thank goodness for Dan and this forum or I would have never made it this far!

I am so happy for you and your wife Peebo! I have followed your case and I know there have been some really frustrating times. Gob Bless you both!!! Keep us posted on how things go with your Marriage Sacrament. I get so caught up in receiving an affirmative of my annulment, I have no idea what happens next! Ha! Ha!

Oh well, one step at a time. Feb.1st will start my 17th month. Soon, I hope.
 
Interesting. My fiancé only needed a signed statement from his mother stating when and where he was baptized.

Also, the our tribunal does not charge any fees for their services. They don’t even request donations.

Bear in mind this is the baptismal cert my former spouse…who wouldn’t even tell me where he was baptized or if he was at all. It made the search exhausting and spanned over several Dioceses before even finding the parish.

I was so worried about being “pushy” but I finally decided two weeks had been long enough…you can imagine after contacting nearly 40 churches and several dioceses and finally finding THE church it took every ounce of me asking God for patience these last two weeks.

When I called this time, a different woman than the one I had to call twice before answered. I told her my reason for calling and she put me on hold to see if she could verify if it had been mailed. She picked up and apologized that she couldn’t find any information about whether or not it had and said the other woman in the office had been out of the office for “time away” so she wasn’t there to ask. When I heard that I felt crushed and worried that she had forgotten to send the certificate. The woman on the phone with me said that she would be willing to make another copy and drop it off at the post office this evening so it would go out first thing in the morning.

I admit I became tearful on the phone. I explained to this woman I was in my own conversion process and there was an upcoming Rite I very much hoped to participate in and in the least I hoped to be able to fully join the Church at Easter Vigil and that this had become a very time sensitive matter. I told her I would be willing to pay for the cost of sending overnight if that was something that could be done. She was very sweet and I think she could tell how emotional I was. She promised me that she would make a copy and have it to the post office and that if my deacon had not received it by the end of this week I could call back and talk about arrangement for overnight shipping as the post office was already closed for the evening in her area.

I don’t know if the other person ever sent it or not, maybe it may show up in the next day after being held up for some unknown reason. But I feel better knowing that another copy is being sent first thing tomorrow and I believe that the woman I spoke to today will keep her word to me. The fax is a really good idea and I may see if that is something that would be acceptable.

Feeling yourself powerless and totally at the mercy of people that don’t seem to care … is rough.
I hit a similar brick wall and was refused a document for my ex. wife, even though I was told I had to get it by my tribunal.

At least you’re ahead of me there, for the person you spoke with is at least willing to help and not treating you like a potential criminal or some kind of apostate against “their” version of the Faith.

One day at a time. 😉

The parish isnt releasing directly to me but the the Deacon helping me. Wouldn’t they be willing to send it to your advcocate, I believe they have to if its for a Tribunal case by Canon law. Don’t give up!
