With all due respect, I think this line of thinking is dangerous to a free people.
I’ll make full disclosure that I am a conservative, and I think modern liberalism is wreaking havoc on America. With that said, I’d rather see a liberal agenda passed legitimately through due process, than see a conservative agenda pushed through by the courts.
Why? Due process involves legislatures and executives, who are accountable on election day, which helps preserve our freedom and liberty. On the other hand, having a handful of judges assume unchecked supremacy over the Congress and president, and substitute their will for the law as an unelected, unaccountable, serve-for-life body having the final say–that, my friend, is the very definition of tyrrany.
A great example is abortion. The constitution is silent on abortion, making it a state power. Yet, five “judicial dictators” substituted their will for the law and made it legal. Using the courts as the final say on what laws should be, rather than their defined role as saying what laws are, makes the Judiciary a despotic branch.
Let’s quit using any vehicle available to push an agenda, and lets move it to the legislature for debate and votes by accountable people, where it belongs. And may the best ideas win, not just the ones a couple judges happen to agree with.
