If you know of a crime, and this is crime against children, and don’t report it, it’s cover-up, IMO.
In your opinion, sure. I agree. But is there a legal distinction between the two scenarios? I’m not asking you specifically, but the general forum. Any lawyers/legal experts willing to chime in?
What would you have to get a child to do to make the picture qualify as “lewd?”
I apologize. The use of the term “lewd” was very misplaced. I should have used a different word. I said lewd because, if I remember correctly, Fr. Ratigan took pictures himself of children’s panties and underwear. There wasn’t any nudity with the pictures he took himself (not the child pornography he had), but they were definitely offensive in a sexual manner. You’re right, though, that lewd was still a misplaced adjective for this scenario.
Do you think, since he pled out, that there was very likely more to the original charges? Such as, a lot of physical contact? Because there is no upside to pleading guilty for him unless the charges were reduced, sometimes to acts the defendant hasn’t actually committed? (I was a cop from a family of cops and criminal attorneys, so this is how it works, pretty much.) Do you think children would be exploited, kidnapped, forced into sex, raped and photographed while doing it if there was no market? Do you think the priest who possessed the child porn has some responsibility for the abuse of the children in the pictures?
When I said in my original post that “the sentence would have been different,” I was referring to Bishop Finn’s sentence, not Fr. Ratigan’s. Just to clear the ambiguity with my post.
I admit I am unsure about how the child pornography market works (I am grateful for my ignorance in some ways, frankly). I certainly understand that those who deliberately purchase/obtain these images only enables the rapists and molesters to continue what they are doing.
I’m not excusing Fr. Ratigan’s behavior at all. But I still feel like there’s a large difference between
having child pornography and
making child pornography. Yes, the former group (those who watch it/obtain it) are very sick individuals and need to be put away for both their own protection and for society’s protection; but those who
make the images and videos, in my opinion, are one hundred times worst.
