In addition to religious liberty objections, many – including the Public Safety Committee report – noted that the bill would be almost impossible to enforce.

This is God’s intervention and I assume the answer to the prayers of many.
 
Even for California, this was extreme. It is hard to believe it passed in the state senate.
 
It passed because the state senators did not want to be going on record as having voted against a bill to purportedly help protect child abuse victims.

I’m willing to bet that everybody knew it was going to end up getting withdrawn. As mentioned above, the enforcement difficulties would have made it a basically useless law.

The best the priest could do is advise the penitent to either “turn himself in” or report an event to the police.

Pretty awesome that the Muslims, Orthodox, Lutherans, Anglicans and Baptists were all on our side too. Of course the bill would have affected any religious clergy person giving counsel or guidance, as the law currently protects all religions in that context, so it wasn’t just limited to Catholic/ Orthodox confession.

I’m also willing to bet that a lot of lawyers were extremely alarmed at the potential erosion of settled privilege law. I note that State Senator Jerry Hill is not a lawyer but instead ran a small business and has some kind of a teaching degree. Figures. This is the type of law that non-lawyers think is a great idea without understanding the ramifications.

True, but even lawyers and law school senior lecturers(hint-one used to be president) can regard the constitution as an enemy of their agenda.
 
The past is prologue per Socialism. One tactic of the USSR during the Cold War was

Two steps forward (one step back).

They constantly advanced overall … but could make much about what they’d “given up”.

Attacking the Catholic Church MIGHT be politically risky. Even if they could get away with it in California … and even in a subsequent appeals court … they must take into consideration that the “Catholic Vote” moved from Obama to Still Obama but much less to Trump instead of Hillary.

And there is another national election in 2020. Another election with more Catholic defections and Congress, Senate, and White House might all go GOP … possibly followed by more conservative judges on the SCOTUS. Invading the confessional might be too big a price to pay for losing power.

We need more priests who would follow the moral over the civil law!
 
It is a settled privilege and is rooted in Western legal tradition.

And the government attorneys in the Epstein Saga negotiated a non disclosure. Yet, that deal has nothing to do with the 1st Amendment.

“Despite all this, California asked a judge to find that the Little Sisters should be forced to comply with the federal mandate (not a state mandate) or pay tens of millions of dollars of government fines.”
