I’m sure that invalidity would be assumed. In fact, I would think that the case wouldn’t even need to go to the tribunal, any more than would the case of a man married to his car.

I guess this brings me to a question… theoretically, if someone who was baptized Catholic and enters into marriage as an unbeliever, but gets married in the Catholic Church because of whatever factors, is it a valid Sacrament since that person doesn’t believe in the Sacraments and doesn’t believe that there’s any difference between a Catholic marriage and a secular marriage? Also, one if one person is a believer and the other isn’t?

The ministers of the Sacrament of Marriage are the couple themselves. So the status of their community in regards to homosexual marriage is irrelevant.
