Catholic Bishop to Defy Freedom of Choice Act, if it Becomes Law

(CNSNews.com) - Bishop Paul Loverde of the Roman Catholic diocese of Arlington, Va., said last week that if the Freedom of Choice Act (FOCA) should become law and a Catholic hospital in his diocese is forced to provide abortions, he would refuse to let the hospital comply, but he would also not close the institution.

Though there are no Catholic hospitals in his diocese, the bishop nevertheless was defiant: “I would say, ‘Yeah, I’m not going to close the hospital, you’re going to arrest me, go right ahead. You’ll have to drag me out, go right ahead. I’m not closing this hospital, we will not perform abortions, and you can go take a flying leap.’ ”

I do not know that the Act will have any criminal penalty. What normal happens when the Federal Government stretches the interstate commerce provision of the Constitution to break violate the rest of the Constitution is that federal funding is halted, meaning they will not make Medicare payments. If they try to institute some criminal penalty it will make the possibility of the whole Act being unconstitutional more likely. I am proud do see a bishop put his neck on the line to be a test case. Religious persectution is alive and well in America today.
 
How refreshing! It seems that the last Pope and this one are choosing bishops who are faithful to Catholic teaching and have Divine courage to stand up for what’s right! It goes against the old joke we used to tell, “How many cardinals does it take to make a bishop? Answer: Three. Two to hold him down, and one to remove his spine.” We’re seeing more and more good, faithful bishops these days!
 
Since this act removes all restraints on abortion, bishops will face this very choice when it comes to Catholic medical factilites in their dioceses. And they aren’t the only ones. Catholic doctors may find that if they don’t perform abortions that they will have to face the law. Even if governments do not take those to court who do not comply with the new legal environment, activist individuals can take those who do not comply to court for civil damages and to face any other sanctions courts may require, including prison terms for those who will not comply with such court orders. This law can cause Catholics and other Christians who will not comply with serious persecution.
 
Nice words on the part of Bishop Loverde – but since there are no Catholic hospitals in his diocese, he won’t have to follow through. Let’s see what other bishops who do have Catholic medical facilities in their diocese will do and say after FOCA is enacted.

Even if there are no Catholic hospitals in his diocese, he is teaching by this very comment. Politicos will listen (including the President-elect).
It will be interesting to see what the bishop in my diocese says/does since we have a very large Catholic hospital organization here. Our ordinary was not one of the hierarchy to make any comment about abortion preceding this last election.

I am not so sure about that. To me, he just comes across as bombastic, and perhaps delusional, going on and on about imaginary hospitals and him taking a bold, personal stance inside of these non-existent facilities.
 
As a Mormon, I recognize the legal side of this and I will continue to pray and work for the truth.

The authorities will act accordingly or not in this world in which we all live.
 
Quick question, Would the Freedom of Choice Act send my money to the feds so that they can help pay for abortions? I’ve heard different things.

IMO, this violates the wisdom: Give unto Caesar what is Caesars.

I don’t understand what the big deal is. No one would be required to perform abortions under FOCA. At worst, hospitals may be required to allow some staff to perform abortions on their premises. How is that that different morally from what’s going on in some Catholic hospitals in the U.S. today?:

On Wednesday, April 24, a young pregnant woman and her boyfriend came to the Pregnancy Counseling Center, a non-profit, non-denominational crisis pregnancy facility in Mission Hills committed to providing pro-life solutions to women with unwanted pregnancies. The woman was visibly distraught and crying. She told the volunteer who helped her that she did not want an abortion. In her hand was a blue piece of paper given to her by a nurse at Holy Cross Hospital (15031 Rinaldi St., Mission Hills) with the address and a map of the cross streets with an arrow for Family Planning Associates, a nearby abortion clinic. The girl told the volunteer that she had been tested for pregnancy at Holy Cross Hospital and sent to Family Planning Associates. She was told that, although Holy Cross Hospital did not perform abortions, they would be glad to give her information about where she could obtain an abortion.

Shocked that a Catholic hospital would offer such information, the volunteer at the Pregnancy Counseling Center called Holy Cross’ maternity center to verify that they had provided a patient the address to an abortion clinic. The people at Holy Cross Hospital claimed ignorance about the matter until a nurse admitted that she had provided the referral. The volunteer told the nurse that she had made a bad mistake and suggested that she learn more about abortion before offering pregnant women the addresses of abortion providers.

When the volunteer told Pregnancy Counseling Center’s director, Julie Ball, what had happened, Ball could not believe it. As a Catholic, Ball was flabbergasted to find that a Catholic hospital offered the addresses of abortion providers to pregnant women and called Holy Cross to find out what was going on. Ball said that the first person she spoke to was Holy Cross operations director Kerry Karmody. Ball said she asked Karmody if Holy Cross was a Catholic hospital, to which he indignantly replied, “of course it is!” Ball then asked Karmody what made Holy Cross a Catholic hospital, and Karmody said, “first of all, it’s non-profit and we are under the principles of the [Dominican] Sisters of Providence.” When asked who the Sisters of Providence got their guidelines from, he sarcastically replied, “the pope!” and hung up.

Its a bit surreal. Some bishops announced they would defy the law that would criminalize aid to illegal immigrants, but they were bishops that were actively involved in that ministry. A lot of politicians live in this diocese so I suppose this is an attempt to influence them. FOCA has nearly zero chance of even getting a floor vote, but given all the rhetoric this year the bishop probably feels he should make his voice heard.

Some people have abortions taking place in their neighborhoods. Some of these people may live closer to the abortion providing clinics than some hospital employees may be to the areas of the hospital that might provide abortions. I don’t see why one would be more or less discomforting than the other or more or less a cause for concern.

You can’t receive gifts from Caesar and keep on receiving the gifts and then defy him. If you want to defy Caesar, at least return the gifts (federal funding).

On the off chance that FOCA passes and it is applied badly, this kind of conflict would be bad for our nation. It would do irreparable harm to society. And no more lives would ultimately be saved since the end result would likely be the governmental seizure of Catholic hospitals and/or Catholic hospitals, when able, defying their bishops.
 
Caesar is not giving any gifts. Fedral Funding is my money, and your money and every other Americans money, that he is obliged to give back to us in some way. He is not giving gifts he is paying back his debts.
You must defy the government if God’s law commands you to, that is the founding principle of our country.

And to address this business of they’re going to get abortions any way. If I had my way, there would be no such thing as an abortion clinic in America. No one can back down as the government attempts to build one on Church property. The Church is supposed to be a beacon of Life and Hope, and building an abortion clinic would be making a mockery of that.

And please none of that it’s sometimes not a beacon stuff. There’s a difference between the fact that some Catholics are hypocrites and legally mandating hypocrisy.
 
Many people on this thread are not filled in on the situation. Tax money is already going to pay for abortions. A great deal of federal money for example is going to Planned Parent facilities used for abortions.
However, any misconceptions will be quickly cleared up if this becomes the law. This law will strike down for example any state laws forbidding partial birth abortions and specificaly requiring patential notification before a teenager has an abortion, We can also expect doctors to be sued for damages and violation of the person’s civil rights after abortion activists take the doctor to court after he refused to perform an abortion.
I expected that this would become law myself until a few days ago, when the election of another Republican senator in Georgia made it possible for the Republicans, if they choose, to block the other party’s push to implement this part of the president-elect’s abortion agenda by filibustering.
 
God bless Bishop Loverde!!! He was our bishop while we lived in Northern Virginia. That diocese is by the far most traditional and firmly in line with the Vatican than any other parish I’ve been in. I miss the parishes up there!!!
