Catholic Hospital no longer argues Fetus is not a person in lawsuit

Excellent news! But I wouldn’t expect to hear too much of it in mainstream media. It isn’t jaw-dropping, WTH?, astounding news like the first news that the attorneys tried to use the “fetus isn’t a person” excuse. Now THAT was a “stop in your tracks” bit of hypocrisy that was bound to go viral. It was so outrageous, that we felt obligated to read and watch as much news about it as possible because our first response was, “no, there must be a mistake here, the media must be misreporting this…” It was real, “hook 'em to the story” kind of news.

The organization’s rap on the knuckles of their overzealous attorneys and admission of the error is just not quite the same. Good news, but not unexpected by any means.

All news is not equal.

This is what gets me. Most states now have wrongful life and wrongful birth causes of action, where parents sue claiming they would have aborted but for the doctors “mistake” or that the child would better off dead, including CO. It would seem strange then to say someone could not sue for wrongful death.
 
I saw it in a number of places before here-Huffington Post, NY Daily News, NY Times…it got reported.

However, my cynic button went off when it took publicity for them to change it. If the newspapers hadn’t gotten a hold of it, my guess is that they would still be pursuing the same case strategy.

Then I am happily wrong! I don’t mind that they publicized it so much. I admire when people have the courage to say they were wrong.
 
Is it not the case that, rather than undermining the Church’s position, the hospital lawyers are just pointing out that the secular law does not regard an unborn infant as a person?

When abortion was legalised (roe v wade) it was justified by saying unborn children are not people.

And if the law says an unborn child is not a person, how can it possibly then convict the hospital on the grounds that it is?
 
The question is whether the hospital, and doctor involved, must defend themselves against wrongful death lawsuits for ONE person, the mother, or THREE, the mother and the twins in her womb.

IMO while the law does “allow” the hospital and doctor to argue that the twins were “fetuses” and therefore don’t matter, a Catholic institution should uphold a higher standard and defend itself against the wrongful death of three, since that is what she in all other ways teaches was present.
