Court orders Emanuel off mayoral ballot

Rahm Emanuel should not appear on the Feb. 22 mayoral ballot, according to a ruling issued by a state appellate court today.

In a 2-1 ruling, the appellate panel said Emanuel does not meet the residency requirement of having lived in Chicago for a year prior to the election. The judges reversed a decision by the Chicago Board of Election Commissioners, which had unanimously agreed that Emanuel was eligible to run for mayor. (Read the ruling here.)

I’m sure Rahm Emanuel was absolutely flabbergasted that any court actually believes a Chicago Democrat has to follow the law.
 
That is great news after a day where Chicago lost. Maybe there is some hope for the city!
 
Surprising news. I read he spent $150,000 dollars yesterday at the Bear game for advertising. And has raised a great deal of funds from donors - living in California.

Wonder if former Illinois resident, President Obama, will be getting involved in someway - if that is even possible?
 
He left one of the biggest and most influential positions in the US to run for mayor and then found out he can’t be mayor? That’s gotta sting

Well I guess this means the dead in Chicago are being disenfranchised. Who are they going to vote for now!

Rahm will be the be the next Mayor of Chicago. This is nothing but a blip on the radar. Watch and see.

Did you read where his tenant wanted $100,000 to get out of the lease, and then temporarily ran for mayor? If something happens to him…

Besides I don’t think one can be prevented from writing him in. Look what happened in Alaska.
 
It won’t stick. Rahm will be on the ticket and will likely win. Let’s face it, he lived and worked in Illinois until taking a temporary job with his friend and ally Obama in Washington (such jobs are usually 2 year positions). Does anybody really dispute your residency if you are off serving in the Peace Corps for 2 years? the military? college?

Ultimately I see the courts treating “public service” (I cringe to call it that in his case) as something NOT revoking previous residency.

And much as I am SO not a fan of his, the next leader in the poles is Carol Mosely Braun. Illinois folk probably remember what a winner SHE is… :rolleyes:
 
I’m no liberal, but there’s something I really like about Emanuel! I think it’s his political deviousness.

That’s only if Chicago allows for write-ins. I don’t know if they do or not. Here in Oklahoma we don’t have the option to write-in. Your stuck with who ever is on the ballot box.

Wouldn’t shock me in the least if this gets over turned. Gotta build up that suspense ya know! 😛

Actually residency is (usually) something different than domicile. His domicile is probably Chicago, IL, but his residency could be D.C. The examples you give are of peoples’ domiciles not changing, but residency requirements for office are generally defined by statute (even if not very well) and people who are away for college, the peace corps, etc. might indeed be barred from running, depending on the statute.
