Because the idea is to lock the perpetrators away, and not take revenge on them, I think.

Besides, the law says up to 3 years and/or fine, so I predict a fine and/or suspended sentence. The idea is that prison has bad effect on people, so you should avoid that if you can teach them a lesson differently.
