The pointed hat or hood carries the sense of judgment and punishment. The interrogators of the Spanish Inquisition wore pointed hats, the KKK adapted that style in their costume.
Hmm Judge Greer should wear one of those hats it would seem appropriate.

Origins

Both the dunce cap and the word dunce owe their origin to John Duns Scotus, a 13th century scholar whose followers wore such hats to increase learning, based on the even older tradition of wizards wearing pointy hats. Originally the word “Duns,” later corrupted to “dunce,” merely referred to followers of Duns Scotus and could be used neutrally or even positively to connote intelligence. With the passage of time, the word was used to denote any fool, and the dunce cap was similarly transformed from mystical apparel to an instrument of humiliation. In this way the dunce cap parallels the mitres worn by Catholic clergy, in that during the Inquisition heretics were often forced to wear paper mitres adorned with devils to their executions.
