According to Islamic scholars, as I’ve quoted above:

**A raped woman is a victim that must be treated with honor and kindness. She is not required to produce four witnesses to prove the crime done against her, nor is she punished for the crime done against her. **

That is the answer in Islam.
 
The “suspect” if found guilty is to be punished with the same punishment as for adultery or fornication. If he is married, death. If he is single, then the lashes. Some scholars say he must pay the woman a dowry as compensation.

What if the man denies the charge and signs the oath, how does the woman prove his guilt?

I recall an example (I don’t think it is a hadith, possibly an example sometime after, but I’m not certain), where a woman had been raped. She accused a man of attacking her, and the man professed his innocence repeatedly, and he was about to be punished. But the guilty man then stepped forward and admitted the crime, and so he was punished.

I bring it up to show that the woman’s testimony is taken over that of the accused attacker.

Nowadays, with the benefit of DNA, it is much easier to prove the identity of a rapist, and that is the preferred method.

I think the muslim jurists have taken to the example of aisha when she was accused. 4 witnesses to convict an accused.

Nobody witnessed Aisha–it was just a rumor, and a slanderous one. She was not punished for that. And frankly it’s not really related. I’m not familiar with any jurists citing the case of Aisha because it was a false slander, and not rape, or adultery. And it wasn’t an accusation of rape in the first place. So it’s not related.
 
What I’m trying to say is, could she have proved it so easily if he had not confessed?

Well her testimony (and guess, even) was apparently enough to convict the first man.

It was another man who confessed–the girl was mistaken.

But still her testimony was enough to condemn the first man.

The Arabs were the messed up people until Prophet Muhammad pbuh starts preaching from the will of One and Only Above. Note Please: Al-Quran is not the author of Prophet Muhammad pbuh. Author is One and Only Above. And its is completed by KHITIBINWAHI.(Reciters Of Verses) And those are companions of prophet muhammad pbuh who he trusted. And Angel of Gabrieal/Jibreel appeared to prophet muhammad pbuh before its finalized in writing form. In simple saying that it is confirm by Angel Gabrieal that it is the right words of One and Only Above. And Quran is completed and distributed around arabia during Prophet Muhammad pbuh lifetime. Yes, because nobody could produce 4 witnesses against Aisha, she was declared innocent.

I think you’re confused. Aisha was declared innocent because God Almighty revealed her innocence in the Qur’an. There was no trial, no testimony, no court involved. It is entirely unrelated.

Moreover, the issue we were discussing was RAPE, right? The slander of Aisha wasn’t rape. If Aisha had been raped, don’t you think she would have said so?

Anyway, back to rape. Please read the example I gave Vickie earlier–the girl’s testimony was enough to condemn a man.

Today there are other ways of proof, like DNA.
 
This is the verse revealing Aisha’s innocence:

24:11 Surely they who **concocted the lie **are a party from among you. Do not regard it an evil to you; nay, it is good for you. Every man of them shall have what he has earned of sin; and (as for) him who took upon himself the main part thereof, he shall have a grievous chastisement.

And here is another about falsely accusing a woman:

24:23 Those who slander chaste women, indiscreet but believing, are cursed in this life and in the Hereafter: for them is a grievous Penalty,-

I’m not sure if it is a hadith or an example of a Companion or jurist.

scratch that… it’s a hadith, I found it:

Narrated Wa’il ibn Hujr:

When a woman went out in the time of the Prophet (peace_be_upon_him) for prayer, a man attacked her and overpowered (raped) her.

She shouted and he went off, and when a man came by, she said: That (man) did such and such to me. And when a company of the Emigrants came by, she said: That man did such and such to me. They went and seized the man whom they thought had had intercourse with her and brought him to her.

She said: Yes, this is he. Then they brought him to the Apostle of Allah (peace_be_upon_him).

When he (the Prophet) was about to pass sentence, the man who (actually) had assaulted her stood up and said: Apostle of Allah, I am the man who did it to her.

He (the Prophet) said to her: Go away, for Allah has forgiven you. But he told the man some good words (AbuDawud said: meaning the man who was seized), and of the man who had had intercourse with her, he said: Stone him to death.

He also said: He has repented to such an extent that if the people of Medina had repented similarly, it would have been accepted from them.

Mohammad asked people to bring four witnesses because he knew that it was impossible to find four men that had witnessed Aisha’s acts in the desert.

It is a fact that Mohammad had many doubts about Aisha’s fidelity after this supposed slander and quitted taking Aisha with him while leading a military campaign.
