Very simply, Roe argued that abortion was justified because it could not be determined whether a fetus was a human life; they called it non viable, or a clump of cells, or a potential human life. It was on this basis solely that the fetus was not a person and abortion could be included under an extended right to privacy. Now that science and biology can pretty definitively demonstrate otherwise, it will be a matter of time before the ruling will be overturned.

It was Justice Blackmun himself who stated so in the original Roe case.

"If this suggestion of personhood is established, the appellant’s case, of course, collapses, for the fetus’ right to life would then be guaranteed specifically by the Amendment.”

It just so happens that Catholic viewpoint was correct before the law got it wrong.
Now that science and biology has caught up, there is basis in the original ruling sufficient to toss Roe completely out. Personhood cannot be separated from human life, and human life begins at conception.

That is not true.
Science. Biology, etc, can without a doubt determine at conception that it is human life, and unique human life and therefore a unique person. Anything else is just denial of fact or reality.

If it’s not unique human life, then what is it?

For the purposes of inheritance law…unborn babies are persons. For the purposes of criminal law…unborn babies are persons. For the purposes of malpractice lawsuits…unborn babies are persons…etc etc etc (There are a few states with exceptions. Colorado is one of them.)

The rights of unborn children have been expanding every year…it is only a matter of time before they are given the full rights of personhood that they deserve.

YES. The so called 'pragmatic " view of the State is the unborn" is a "person " whenever the mother says they are

Yes, our Church always holds that when, the health and safety of the woman is involved, a fetus is a legal person and cannot, under any circumstances, be aborted. But when the finances of our Church are at risk, it may be a different story. See how St. Thomas More Catholic hospital responded to a wrongful death suit involving the unborn twins in Canon City, Colorado.

A lawyer for a Dr being sued for malpractice wrongly stated the Church’s position. The idea that this Dr or this Hospitals actions has any relevance to the teachings of the Church on abortion is specious.

The attorneys in the case were arguing civil law, not the Churches position on whether an unborn person is still a person. Arguing otherwise would not change a thing in that case.
