This is the case on the federal level. I find this interesting because so many people will say sex laws are only needed for non consensual sex. In fact that is the legal standard as upheld by the Supreme Court. But here there is no person behind harmed save the man himself who committed the crime.
So as it turns out most of society, and even the hypocritical courts, agree that we should have laws that prevent sex acts, including thoughts, where there is not an issue of consent. So society is absolutely legislating sexual morality.
