It is not appropriate to accuse a bishop (or anyone else for that matter) of heresy.
Pope Leo X would disagree:

[Exurge Domine] , Pope Leo X described his subject (Martin Luther-clergyman) as “one whose faith is notoriously suspect and in fact a true heretic.”
 
An accusation of heresy is a serious matter (Pope Leo X would agree with that) since each person enjoys the right to a good reputation (again, straight from Canon Law that) and so should not be made without adequate foundation (this usually involves a canonical trial). I would however ask why the subject was even raised in the first place?

The difference is that Leo X is a pope, and that Martin Luther did much more than ommiting the Creed.
