Can. 1061 §1. A
Code:
valid marriage between the baptized
is called ratum tantum if it has not been consummated; it is called ratum et consummatum if the spouses have performed between themselves in a human fashion a conjugal act which is suitable in itself for the procreation of offspring, to which marriage is ordered by its nature and by which the spouses become one flesh.
§2. After a marriage has been celebrated, if the spouses have lived together consummation is presumed until the contrary is proven.
§3. An invalid marriage is called putative if at least one party celebrated it in good faith, until both parties become certain of its nullity.

Can. 1142 For a just cause, the Roman Pontiff can dissolve a non-consummated marriage between baptized persons or between a baptized party and a non-baptized party at the request of both parties or of one of them, even if the other party is unwilling.

I would not ask you to reveal intimate details about your marital history here, but perhaps your marriage was both unconsummated, but found null for some legitimate ground (either perpetual and antecedent impotence or some other ground)? 🤷 :twocents:

By my understanding, the Church;s teaching is that (unimpeded) consent makes a valid marriage; consummation makes a (already valid) marriage indissoluble.

Not A Canon Lawyer
I think there are so many canon lawyers or people who know more than a priest here so I better back out already… My marriage was annulled due to non-consummation with impotency on his part. As a practicing catholic, I have lived chastely all my life and have thus rpoven the rato no consumado marriage easily by virtue of the proof of viriginity. The marriage has been annulled. Period… I would have wanted to stay in the marraige despite not being consummated but his illness got worse and worse and tried to kill me

With regards to the Original poster, if the marriage is doing well and you choose to live in a Josephite marriage, you can can have that convalidated int he Church.

I believe what people are saying is that the inability to consumate a marriage, if it was prior to the marriage, is grounds for annulment. However, the free choice of capable spouses to not consumate the marriage is not.

With the OP, the likely situation is that as they are not having marital relations, the lack of a valid marriage would render them in the eyes of the church simply male and female roommates - a situation which is not in itself sinful.

I’m not catholic so apologies if I have not understood but many of the replies don’t appear to address the OPs concerns. She has not asked about annulment/dissolvement.

Her questions relate to
  1. whether she can receive the Eucharist in her current state
  2. having her marriage blessed
I don’t know about the second but my albeit limited understanding of the first is that her priest is right - she can receive the Eucharist. Although her marriage is invalid in the eyes of the church, she is not having sexual relations and therefore isn’t commiting a sin (ie sex outside of marriage).

Thank you very much to everyone who answered.

I am happy in this Josephite marriage and I am very glad no one had a specific objection from CCC that I could not receive Holy Communion, which was my main concern. I will contact my local Tribunal to make sure everything else is in place, thank you to Seminarian for the contact info.

May God bless you all for taking the time to answer this for me!
