Judge sends church abuse lawsuits back for jury trials

SAN DIEGO – A federal bankruptcy judge Friday agreed to send 42 child sex abuse lawsuits against the Roman Catholic Diocese of San Diego back to state court for jury trials.
Judge Louise DeCarl Adler, who earlier this week signaled she was leaning toward releasing to state court this first batch of cases, wrote in her decision that the victims have a constitutional right to trials.
Adler also said that based on what she’s seen during the 6-month-old bankruptcy case, “absent a settlement of the claims, prompt resolution … is unlikely.”

The Church will have to settle these cases; a jury trial is just too risky.
 
I remember seeing an article about tobacco lawsuits in CA going to jury as well. The writer wondered aloud if it was even possible that they could get a fair trial, given that could any potential jurors in the state had been submerged in anti-tobacco advertising paid for largely by the state for the previous 30-40 years.

Several of the jury trials against tobacco companies have seen jurors finding against the accused and awarding grossly inflated amounts to the victims not because of any suffering or damage but (according to more than one juror, post-trial) because “those evil tobacco companies need to be taught a lesson.”

I have to wonder if this decision isn’t somehow related to the way jurors tend to base their decisions more on their feelings about the “bad guy” than about justice or truth.

If I were greedy and I only wanted money and not justice, for a real or perceived wrong, then I would definitely want to ask for a jury trial. This does not mean I want the trial itself. I might just feel that the fact that I was “dragging them into court” might get me MORE MONEY offered to get me out of their hair.:eek:
 
While I realize a jury award would be very expensive, I would like to see some of the cases go to trial. It is the only way the truth will come out.

I love the Church and I am sickened by the expense of the lawsuits and outrageous awards, but I want to see justice. Money is not as important as justice; and we have seen precious little of that in many of these cases.

I should add that I am sickened by the abuse dealt out by those in the Church to the innocent children. My heart has nothing but pity and prayers for those victims.

As I pray we have for all victims of abuse. The people that abuse anyone should be punished. But the person that is the most trusted should be punished even more. I believe in my heart that this will be the case when standing before God.

My prayer is that the Lord is not the only to deal out justice to these… (trying to think of a word that will not get me banned…) creeps.

Sometimes I think I would like to have seen those that abused me be punished.
But, then I think that I would prefer that they truly repent and go to Heaven. I pray for them daily. Yet I know that God is just and that even those that have repented will spend some time Heavenly separation (Purgatory). But then I am now 60 years old and was just a child when things happened.
 
i posted a question similar to this on another thread: our legal system is based on a trial by one’s peers. may then it be assumed that the juries or judges in the civil trial, did not and/or do not have any-one who harbors evil intent against the catholic church? i don’t personally know but i do believe the question must be addressed. have a good year. (alih)🤷

This is not necessarily true. A lot of this depends on the politics of the particular judge in the case. I developed carpal tunnel about 10 yrs ago and under went workers comp. I ended settling with the company (NOT by my choice, I wanted to go back to work!). One of the things my attorney told me when he gave me the settlement amount was that going to trial does not automatically mean more money and that because of the politics of the judges at that time I would most likely ended up losing most of what I was being given. Which was mere pennies compared to what the victims here are getting. Needless to say, I decided it was wiser to settle instead of risking it in a trial.

Yes BUT you were probably not a high profile victim (poor me see me) with charges against a very visible public entity (big big bad rich church).
