In an incident which was a high-profile Catholic news items some months ago, a Louisiana court said a priest there must testify about what was told him while giving the sacrament of confession, something absolutely forbidden by the Church, and which would mean the excommunication of any priest who does this. This case has gone to different courts, several of which ruled against this priest, but now an appeals court has just ruled that he does not have to testify about any discussion which occurred during confession.

Given that the plaintiff testified that she told the priest of the abuse in the confessional, even if he did not have a duty to report, the question remains: would a jury grant a verdict in a civil case against the priest and/or the diocese. If she has testified, the case appears to be moving forward.
