At the same time, if people would stop breaking the law, we would have less problems
There will always be a certain percentage of people willing to break the laws, and no law is 100% effective, but that does give the authorities the right to be suspicious of everyone, and/or especially taking advantage of those who do not know their rights that well to further their investigations, such as intimidating someone who refuses a search of vehicle, refusal to give name or ID, etc.
We have those rights for a reason, if police try to take advantage of people who try to exercise them, why should we react any different than they do in the same situation?
Body cameras would be helpful to some extent in this regard, but I still think police would try ‘sneaky’ methods to try and gain permission to search or acquire name/ ID, etc.
Ive been thru this before, when I was in my late teens, out late with friends, police pulled us over and got us all out of the car, intensely asked where we were going, where we were coming from, why we were out that late, They separated the 3 of us, and had 2 more cops come to the scene to assist, they asked the driver permission to search, he asked why and denied, the cops thought this was funny, started asking why anyone would deny a search if they had nothing to hide, I saw this first hand, it was very intense, they used pressure to try to and get permission, when he still refused, they started in on other things, well, we could hold your car for up to 48 hours if we feel it is needed, this person over here said something different, etc etc, so on and so on.
After awhile, he still refused and eventually they released us, but he did get a ticket for some equipment defect, something minor, but it was an eye opening experience for me. Imo, when they were refused the search, they should have left and not been able to discuss this further, why should a civilian be scrutinized intensely for exercising their rights about a search, but the cop is able to intimidate and use sneaky tactics to gain permission, basically the same thing?
