Man sucker-punches man for not wearing a mask, is this a hate crime?

If it seems that he was attacked because of his race then the attacker could be charged with a hate crime, I believe. I remember reading somewhere that one of the first hate crime cases in the US had a white victim, though that could either be a different country or it could be something I am misremembering.

Assuming the crime was motivated by an argument over a mask, then no, not a hate crime. Still a crime, just not a hate crime.

Was the action motivated by prejudice on the basis of actual or perceived race, religion, sexual orientation, nationality, ethnicity, or disability status?

If not, then no.

How does one know? Words seem to be a factor but not always.

I don’t know if it’s officially a hate crime but what on earth has gone wrong with people??!!

I have to wonder was this really about the mask or was it really about some underlying racial hate that was going on?
Racial tensions in US have flared so much and it seems like some are very quick to malign any one of a different race, lump them all in together as if they are one, and are looking for a fight.

The man in the video was clearly trying to walk away and avoid a confrontation. This is so wrong regardless of the race😞.

If it’s truly about the mask, then people can’t just go around beating others up if they refuse to wear a mask in public…

One doesn’t always know. But sometimes a person will declare their disposition to people based on the above listed attributes at the confrontation, to others, or on social media.

If someone successfully keeps their noth shut, then no one will know.

When they declare it outright but that’s seldom,. I am not sure in this case.
 
Again, here is a short video clip. Words are said, but it is not quite clear what is said. The young man that helped pick up the elderly man, had his mask down as if he was apparently in a conversation.

We do not know the whole situation and what led up to assault.

That said, assaulting someone is a crime and finding out the motive requires investigation into the whole situation.
 
Clearly not afraid of lack of social distancing, so why punch the guy for not wearing a mask?

If it was about social distancing, he certainly wasn’t afraid to get close to the man with no mask, that is what is confusing. The man turned away so why the punch.
