Well, he DOES live in Massachussetts, where same-sex “marriage” is “allowed for” by state law. It’s even possible that according to the state, the Catholic school has now committed a “hate crime”. And this isn’t just in MA.

Several years ago, before same-sex “marriage” was allowed in any state, a NM photographer was sued by a homosexual couple because she refused to take pictures of their “committment ceremony”. The case went all the way to the Supreme Court of NM last year (still before NM allowed same-sex “marriage”), and the justices unanimously declared that such discrimination was considered a “hate crime” under the NM Constitution. Seriously.

See, the thing is, many in the homosexual community will not be satisfied until their “marriages” are accepted by everyone. The homosexual community knows that if they enter into a homosexual “marriage”, they won’t be allowed to work at a Catholic institution. They actually intentionally apply to Catholic institutions so that they can be refused hiring (or be fired) for being in a homosexual “marriage” and then sue them. The purpose is to show the Catholic Church as being “intolerant”, and to try to force the Church to accept what has been condemned as intrinsically sinful. It doesn’t even matter if they win the lawsuit (though, they would LOVE to win the lawsuit) - it’s to be able to drag the Church through the mud of the secular media.

It’s a Catholic prep school for girls! Don’t Catholic school employees have to agree to publicly uphold Catholic Church teaching? Surely the school has a morals clause addressing this issue.

If a Catholic school can be forced by the state to hire employees who do not abide by Catholic principles, the school can no longer be Catholic. It can essentially be forced out of business.

In Massachusetts there is an exemption from the gay rights law for religious institutions, but it’s not an absolute exemption.

According to the state law site, a religious institution may discriminate “with respect to matters of employment . . . which are calculated by such organization to promote the religious principles for which it is established or maintained.” He seems to be trying to make the argument that he’s only serving food, not teaching students, and that the school doesn’t need to hire a Catholic to do that.

He said he was never presented with a morals clause. But then again, he never made it to his first day of work. The paperwork should have been part of the standard - new employee documents that employees go through on their first day of work.

For someone to so openly and clearly do something against church teaching, then have the gall to apply for and get a job within the church and to sue when it was taken away I’m afraid I have little sympathy. This is truly the age of stupid.

Not really. Why should the Catholic church be obligated to employ anyone other than a practicing Catholic? I know a girl who worked for the Catholic school system while living with her boyfriend and had to keep this also unacceptable lifestyle secret from her employer for the same reasons. At least she was brighter than this Massachusettsan.

The problem is, though, under the law as it is now, the exemption isn’t all-inclusive.

He makes the point in the complaint that the school “does not limit admission to students who are Catholic” and “does not limit employment to members of the Catholic religion.” It seems that if he can point to another food service employee who’s not Catholic/practicing Catholic, maybe just one of the “lunch ladies” who’s a single mother living with someone before marriage, he’s got an argument that hiring Catholics for food service isn’t all that important to the school’s Catholic mission.

The gays that are attempting to fight this really don’t understand this issue in the first place. They’re not being discriminated against because they’re gay, but rather because they are in an invalid marriage. Heterosexual marriage has been allowed for even longer, and heterosexual couples in invalid marriages are subject to exactly the same “discrimination” for exactly the same reasons.

Be careful with the comparisons. Religious and secular-public entities are not treated the same. Details matter.
 
CCC 2358 The number of men and women who have deep-seated homosexual tendencies is not negligible. This inclination, which is objectively disordered, constitutes for most of them a trial. They must be accepted with respect, compassion, and sensitivity. Every sign of unjust discrimination in their regard should be avoided. These persons are called to fulfill God’s will in their lives and, if they are Christians, to unite to the sacrifice of the Lord’s Cross the difficulties they may encounter from their condition.

It looks to me like the school is violating the Catechism in addition to violating state law.

The Catechism does not approve of same sex marriages or same sex relationships. It says that we must accept those with same sex attractions with compassion. So must we treat everyone with compassion. It is not unjust discrimination to require employees of a Catholic school to act in accordance with Catholic moral teaching.

In order to protect themselves, Catholic schools and churches and other institutions may have to either limit hiring to practicing members of the Catholic Faith, or have a strong morals clause requiring that employees do nothing to undermine the Catholic Faith, or both.
